JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department, Code 02
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for critical equipment to be used by the Gun & Electric Weapon Systems Department (E), Test & Evaluation Division (E40), manufactured by Weibel Scientific.
3. Description of Supplies/Services
The Potomac River Test Range (PRTR) Test Engineering Branch (E43) currently has a requirement to procure two (2) Tracking Radar Systems and Supporting Accessories from Weibel Equipment Inc., manufactured by Weibel Scientific, to expand current testing capabilities. This effort also includes system set-up, interconnection, start-up and training on the system once operational. Delivery is required twelve (12) months after receipt of the order, or sooner, if available.
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated cost of the proposed contract action is $5,475,562.00. Fiscal year 2021 Research, Development, Test, and Evaluation funds will be provided for this procurement.

5. Rationale Justifying Use of Cited Statutory Authority
The NSWCDD/E43 has a requirement to expand and enhance our current radar capabilities by obtaining two (2) Weibel tracking radar to meet current and future Hypersonic Projectile development programs. The requirement is that the system(s) is fully compatible with our existing Multi Frequency Tracking Radar (MFTR-2100/39-160) with the 300MHz oscillator purchased at a cost of $1,800,000.00. This specific radar and supporting accessories/software is required to ensure compatibility and interface with existing equipment and capabilities, and to obtain consistent data across past and future testing. In addition, the E40 workforce has developed written and approved operations and maintenance procedures for the existing Weibel Radar system and supporting equipment. These procedures are directly applicable to the Weibel system. A radar system from another manufacturer would require replacement of the existing system, re-design and extensive testing, retraining of personnel and research and testing to develop new operating and maintenance procedures, resulting in an additional costs in excess of $2,000,000.00 This additional cost could not be recovered through full and open competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research revealed that Weibel Equipment Inc. is the authorized reseller in the US and a legal subsidiary of Weibel Scientific A/S from Denmark who is the original manufacturer of the MFTR-2100/39-160 tracking radar systems. There are no additional authorized US resellers.
The proposed contract will be synopsized on beta.SAM.gov website No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Weibel Scientific to provide the required equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
