1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than full and open competition basis per 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1.

3. The supplies required to meet the using activity's needs are described as follows:

Circuit Card Assembly: The Circuit Card Assembly is a grouping of two or more physically connected or related electrical a/or electronic parts capable of dissassemblage. Each component of the assemblage must be capable of functioning in accordance with its own item name. Consists of a single printed circuit board or terminal board upon which are mounted separately manufactured electronic components such as capacitors, inductors, resistors, and the like. It may also include printed electronic components. The item is generally part of a subassembly and cannot be assigned a more definite item name.

4. The statutory authority permitting other than full and open competition is:

(X) 10 U.S.C. 2304(c) (1) - Available from only one or a limited number of sources.

5. If restricted to the only source(s) of supply include source(s) and CAGE code: L3Harris Technologies, Inc. (14304) per DLR tech data from Albany, GA. Technical information was certified as complete and accurate by the product specialist via attached DLR Technical Certification dated June 23, 2020. L3Harris Technologies, Inc. is the only manufacturer with technical data to manufacture this item. We are limiting competition to the manufacturer’s item not who can participate in solicitation as we will openly welcome competition amongst dealers/distributors.

The use of the authority cited is based on:

(X) AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The use of the authority cited is based on:

(X) AMSC H. The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

Technical information, including the AMC/AMSC codes and approved source, was certified as complete and accurate by the product specialist via attached DLR Technical Certification dated June 23, 2020. L3Harris Technologies, Inc. physically has in its possession sufficient, accurate, and legible data to manufacture this item and this information is not available to the Government. We are limiting competition to the manufacturer’s item not who can participate in solicitation as we will openly welcome competition amongst dealers/distributors.

A request was sent to LOGCOM via email July 30, 2020 to request that SYSCOM review the AMSC code assignment. In an effort not to delay the procurement, actions are moving forward. If SYSCOM makes a change to the ASMC code assignment, then an addendum will be written to this document but otherwise, it is assumed that the AMSC code assignment will remain unchanged. In an effort to ensure that validation of the AMSC code assignment and sources were reviewed, WebFLIS was researched to confirm that the only source listed for this item is L3Harris Technologies, Inc.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] The acquisition will be synopsized on or about August 12, 2020 for 15 days prior to the solicitation opening. At the completion of the synopsis period, this PR will be solicited on the internet for 30 days via the DLA Internet Bid Board System (DIBBS).

[X] Other. (Explain): A Source Sought Notice (SSN) posted to FedBizOpps from July 30, 2020 to August 10, 2020, with no responses received.

7. In addition, the buyer will request an informal cost breakdown from offers’ to assist in deeming the price fair and reasonable, per FAR 15.403-3 - Requiring data other than certified cost or pricing data. Contracting Specialist searched Haystack for similar item for analysis with no success. L3Harris Technologies, Inc. will be asked to provide a similar item to assist in developing the targets/deeming the price fair and reasonable.

Certified Cost and Pricing data will not be required because the estimated value threshold does not exceed $2.0M per DAG 15.403-4 or DLAD 15.402-90.

Based upon the above techniques, the Contracting Officer hereby determines that the anticipated cost to the Government will be fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

Describe the market research conducted and the results. A market survey was submitted via email to L3Harris Technologies, Inc. and to Science Applications International (SAIC)/79343, an authorized large business distributor for L3Harris Technologies, Inc. The market survey (consists of approximately 24 general questions). The results of the market survey will be discussed in detail under “Type of information requested”.

Market Survey [10 U.S.C. 2304(f)(3)(D)]:

(X) A market survey was conducted on/during: July 30, 2020 through August 10, 2020.

Total number of vendors contacted: 2 (two) Names of vendors contacted: L3Harris Technologies, Inc. and SAIC Techniques used to conduct survey: Source Sought notice and email communication with market survey attached.

Types of information requested: A sources sought was posted in FedBizOpps on July 30, 2020 with a response day of August 10, 2020. The main purpose of source of sought was to provide an opportunity to other potential sources to manufacture this NSN in order to promote competition. Sources that are not approved for this NSN were required to submit a Source Approval Request (SAR) to DLA Land and Maritime. DLA Land and Maritime does not manage this item, therefore, the SAR package is submitted to LOGCOM who manages the NSN. LOGCOM would then submit the SAR information to SYSCOM, since they manage the technical portion of the NSN. While the approval of the SAR would not necessarily occur for this procurement, the SAR could be reviewed for future procurements. For this procurement, there were no SAR packages submitted. Additionally, a market survey was included with the NSN to allow potential offerors an opportunity to provide feedback on the current marketplace for

2.101 & 3.104) this acquisition. The market survey included but not limited to information regarding commerciality, EDI, MIL- STD-129 capability, company size, FOB, Inspection and Acceptance, part number, quantity, delivery and OEM information.

Summary of information received: The sources sought closed without receiving any responses for vendors submitting a SAR.

L3Harris Technologies, Inc.

This procurement is a code and part number 105-213000-001 buy to L3Harris Technologies, Inc. L3Harris Technologies, Inc. is a large business manufacturer per their SAM registration. L3Harris Technologies, Inc.

did not complete the market survey. (POC) from L3Harris Technologies, Inc. stated via email March 30, 2020, that they manufacture the part number and the item is commercial. Finally, stated SAIC is L3Harris Technologies, Inc. authorized distributor for this part number and they would be providing a completed market survey. (POC) from SAIC completed and returned the market survey. Information sought on the market survey included business size, quantity sensitivity for this item, if the item is carried in the inventory, if a dealer/distributor network exists, the anticipated delivery for this item, if the item is commercial, which FOB & I/A is acceptable, if the OEM recognized part number, and if the contractor is EDI & MIL-STD-129 markings capable

SAIC . SAIC stated the item is commercial Quantity ranges, options, or zone pricing are not applicable for this requirement. Most of the provisions selected by contractor were “Yes” or “No” answers .

Information received regarding the commerciality of the item(s): L3Harris Technologies, Inc. stated the item is commercial via email when they validated the part number. SAIC also stated the part number is commercial.

SAIC provided L3Harris Technologies, Inc. commercial price list. The part number is also available from L3Harris Technologies, Inc. GSA schedule under contract number GS-35F-0163N. Based on this information, the Contracting Officer hereby determines that this item is commercial and FAR Part 12 procedures will be utilized for this procurement.

9. Additional facts supporting other than full and open competition are:

(X) Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition (see Attachment 1). The data presently available reflects the minimum needs of the Government.

10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state)
