I. Contracting Activity.

II. Nature and/or description of the action being processed.
This Individual J&A is for a new firm-fixed price (FFP) sole source commercial contract to procure six (6) each additional B-52 Anti-Skid Mark IV Group B kits. This requirement is for support of the ongoing B-52 Anti-skid Mark IV Replacement Program and will be used by the Air Force B-52 weapon system. This is not a Bridge Action.

III. Description of supplies/services required to meet agency needs.
This is a supply contract. The purpose of this procurement is to replace six (6) each Anti-Skid Mark IV Group B kits (NSN Kit #: 1560K0102016BFG) that were erroneously sent to Defense Reutilization and Marketing Office (DRMO) by the Defense Logistics Agency (DLA) and destroyed or lost. A B-52 Anti-Skid Mark IV Group B kit consists of the following items and quantities:

Crane will provide the following:
CLIN 0001 (FFP) six (6) each Anti-Skid B Kits for a unit price of approximately $333,333 and an anticipated delivery date of 30 September 2020 for all kits. The type of appropriation is 3010 procurement funds.

IV. Statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 10 USC 304(c)(2), as implemented by FAR 6.302-2(b).
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
In accordance with FAR 6.302-2(b)(1) and (2): This authority, authorizing the exception to full & open competition, applies in those situations where (1) an unusual and compelling urgency precludes full and open competition, and (2) delay in award of a contract would result in serious injury, financial or other, to the Government.
The above authority was selected because the B-52 Program Office has an immediate requirement to procure six (6) replacement B-52 Anti-Skid Mark IV Group B kits to complete installation of Time Compliance Technical Order (TCTO) 1B-52H-952 on the B-52 fleet.
The previous contract, FA8107-15-C-0005, was awarded in a non-competitive environment to Crane on 08 September 2015 and was production complete on 28 November 2018. Crane manufactured and delivered 76 B-52 Anti-Skid Mark IV Group B Kits to the Air Force under the previous contract. The purpose of this procurement is to replace six (6) each Anti-Skid Mark IV Group B kits that were erroneously sent to DRMO by the DLA and destroyed or lost. The Anti-Skid Mark IV Group B kits are currently being installed on B-52 aircraft at Barksdale AFB, LA and Minot AFB, ND via contract FA8108-17-D-0010/FA8108-19-F-0004. The Contract Field Teams (CFT) doing the installations will be unable to complete all 76 aircraft without these six (6) Anti-Skid Mark IV kits and will be at a work stoppage in the September 2020 timeframe.
Without kits in place, the CFT installation contract would terminate due to a significant lapse in service. This unacceptable delay in installation of the kits will result in an adverse impact to military readiness.
Very limited Mark IV spares were procured for the upgrade effort. Therefore, there is nothing in supply to pull from to fill the gap. There are also no available contracts in place to provide complete Anti-Skid “B” kits. Spare buys were limited because at the time the kits were originally purchased, the estimated Mean Time Between Failure (MTBF) of the Line Replaceable Units (LRUs) were quite large.
Unavailability of the kits for a September 2020 install has a negative impact to aircraft availability (AA) and military readiness. The next scheduled time to bring these aircraft down would be during Programmed Depot Maintenance (PDM), which is 5 plus years away. The impact of taking these aircraft down out of cycle to install this mod equals up to a negative 6 AA hit per month until all aircraft are modified. Due to recent real world events, AA is a top priority. The B-52 is the go-to platform for 11 new weapons including the new Long Range Cruise Missile and several hypersonic weapons demos and integrations efforts for the Secretary of Defense, Secretary of the Air Force, Air Force Strategic Command, Defense Advanced Research Projects Agency, Air Force Nuclear Weapons Center and Air Force Global Strike Command. The B-52 has multiple major modifications in work, all

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to submit Other Than Certified Cost or Pricing Data. A thorough price analysis will be performed. The Contracting Officer may request a technical evaluation from the B-52 Program Office to aid in the evaluation of the contractor's proposal.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was only conducted to the extent practical for this urgent requirement. The previous effort, FA8107-15-C-0005, Crane manufactured and delivered 76 B-52 Anti-Skid Mark IV Group B Kits on a sole source commercial contract.
Since the Government does not control the design or own the data required to manufacture the B-52 Anti-skid Mark IV system, there are no feasible actions that could develop future competition as referenced in section V.
Crane is the patent owner of the Mark IV Anti-Skid system. None of the B-52 Anti-skid components are based on commercial parts available on the market from a source other than Crane. The Government does not have, cannot purchase, or otherwise obtain the data use rights to the Crane Mark IV drawings and parts, which would be required for release to other sources for production of the Mark IV Group B kits. Crane provided a letter dated 27 January 2020 declining the Government's inquiry regarding purchasing Mark IV drawings or data rights to protect its intellectual property.
IX. Any other facts supporting the use of Other Than Full and Open Competition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Although this is a one time purchase and no follow-on contracts are currently anticipated, the refusal by Crane to provide or license data as well as the duplication of cost and unacceptable delay of developing additional sources per Sections V indicates there are no known additional actions which can be taken to remove barriers to competition. Therefore, specific actions and milestones cannot be established.

XII. Certification by the Contracting Officer.
The contracting officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.
XIII. Certification by the technical/requirements personnel.
By their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein IAW FAR 6.303-2(c).
