1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies for a Seat, Vehicular for the following National Stock Number (NSN) 2540-01-662-7858 for part number 105-213000-001. Other than full and open competition basis per FAR 6.302-1 and 10 U.S.C. 2304 (c) (1) will be utilized since after market research (FAR 10) was conducted and the Marine Corp. technical data it was determined the current NSN is sole source to Shockride, LLC DBA ArmorWorks (4YJ37). Shockride, LLC DBA ArmorWorks is the only known provider of this item to meet the services’ needs. We are limiting competition to the manufacturer’s item not who can participate in solicitation as we will openly welcome competition amongst dealers/distributors.

This seat is designed to accommodate one or more persons (operator and/or passengers) for use on ground vehicles, construction equipment, machinery and the life. It may be covered, padded, upholstered, and equipped with arm and or backrest. A support seat, vehicular may be included if it is permanently fastened to the seat.

5. If restricted to the only source(s) of supply include source(s) and CAGE code: NSN is sole source to Shockride, LLC DBA ArmorWorks (4YJ37) per DLR tech data from Albany, GA. Shockride, LLC DBA ArmorWorks is the only manufacturer source specified on the source control or selected item drawing.
The use of the authority cited is based on:
(X) AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The use of the authority cited is based on:
(X) AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
A request sent to LOGCOM on 13 April 2020 to request that SYSCOM review the AMSC code assignment. In an effort not to delay the procurement, actions are moving forward. If SYSCOM makes a change to the ASMC code assignment, then an addendum will be written to this document but otherwise, it is assumed that the AMSC code assignment will remain unchanged. In an effort to ensure that validation of the AMSC code assignment and sources were reviewed, WebFLIS was researched to confirm that the only source listed for this item is Shockride, LLC DBA ArmorWorks.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[X] The acquisition will be synopsized on or about March 26, 2020.
[ ] Manufacturers of similar products identified in the market research will be solicited.
[ ] Dealers of the manufacturers will be solicited.
[ ] A synopsis exception cited in FAR 5.202 applies. (explain) [X] Other. (Explain): A Source Sought Notice (SSN) posted to FedBizOpps from March 2, 2020 to March 13, 2020, with no responses received. Based on the technical certification that as provided by LOGCOM (Logistics Command) (see Attachment 1), SYSCOM (System Command) does not own the drawings for this Seat, Vehicular to allow for full and open competition to exist. The item needs to be procured from the sole source manufacturer, based on the tech data.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
The current requirement is sole source to Shockride, LLC DBA ArmorWorks. The solicitation will be solicited for 30 days. The requirement is for a quantity of (24) EA for NSN 2540-01-662-7858 for part number 105-213000-001 for a total estimate of $463,584.48 ($19,316.02 each).
In addition, the buyer will request an informal cost breakdown from offers’ to assist in deeming the price fair and reasonable, per FAR 15.403-3 - Requiring data other than certified cost or pricing data. Contracting Specialist searched Haystack for similar item for analysis with no success. Shockride, LLC DBA ArmorWorks will be asked to provide a similar item to assist in developing the targets/deeming the price fair and reasonable.
Certified Cost and Pricing data will not be required because the estimated value threshold does not exceed $2.0M per DAG 15.403-4 or DLAD 15.402-90.
8. Market Research/Efforts to Obtain Competition:

Describe the market research conducted and the results. A market survey was submitted via email to Shockride, LLC DBA ArmorWorks and to Triman Industries, Inc., an authorized large business distributor for Shockride, LLC DBA ArmorWorks. The market survey (consists of approximately 24 general questions). The results of the market survey will be discussed in detail under “Type of information requested”.
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
(X) A market survey was conducted on/during: March 2, 2020 through March 13, 2020.
Total number of vendors contacted: 2 (two) Names of vendors contacted: Shockride, LLC DBA ArmorWorks and Triman Industries, Inc.
Techniques used to conduct survey: Source Sought notice and email communication with market survey attached.
Types of information requested: A sources sought was posted in FedBizOpps on March 2, 2020 with a response day of March 13, 2020. The main purpose of source of sought was to provide an opportunity to other potential sources to manufacture this NSN in order to promote competition. Sources that are not approved for this NSN were required to submit a Source Approval Request (SAR) to DLA Land and Maritime. DLA Land and Maritime does not manage this item, therefore, the SAR package is submitted to LOGCOM who manages the NSN. LOGCOM would then submit the SAR information to SYSCOM, since they manage the technical portion of the NSN. While the approval of the SAR would not necessarily occur for this procurement, the SAR could be reviewed for future procurements. For this procurement, there were no SAR packages submitted. Additionally, a market survey was included with the SSN to allow potential offerors an opportunity to provide feedback on the current marketplace for this acquisition. The market survey included but not limited to information regarding commerciality, EDI, MIL- STD-129 capability, company size, FOB, Inspection and Acceptance, part number, quantity, delivery and OEM information.
Summary of information received: The sources sought closed without receiving any responses for vendors submitting a SAR.
Shockride, LLC DBA ArmorWorks This procurement is a code and part number 105-213000-001 buy to Shockride, LLC DBA ArmorWorks.
Shockride, LLC DBA ArmorWorks is a large business manufacturer per their SAM registration. Shockride, LLC DBA ArmorWorks did not complete the market survey. Ms. Annett Furman from Shockride, LLC DBA ArmorWorks stated via email March 30, 2020, that they manufacture the part number. The item is not commercial, there is a minimum quantity buy of (5) and delivery will be 18-20 weeks. Finally, Ms. Furman stated Triman Industries, Inc. is Shockride, LLC DBA ArmorWorks authorized distributor for all DLA requirements and they would be providing a completed market survey. Ms. Nicole Rost from Triman Industries, Inc. completed and returned the market survey. Information sought on the market survey included business size, quantity sensitivity for this item, if the item is carried in the inventory, if a dealer/distributor network exists, the anticipated delivery for this item, if the item is commercial, which FOB & I/A is acceptable, if the OEM recognized part number, and if the contractor is EDI & MIL-STD-129 markings capable
Triman Industries, Inc.
Triman Industries, Inc. does have a parent company, which is Shockride, LLC DBA ArmorWorks. Triman Industries, Inc. stated they do not carry this item in stock, item is quantity sensitive and the item does not contain hazardous material. Triman Industries, Inc. stated the item is not commercial. Triman Industries, Inc.
stated a minimum quantity of (5) applies to this item. Quantity ranges, options, or zone pricing are not applicable for this requirement. Most of the provisions selected by contractor were “Yes” or “No” answers.
P/N was confirmed with Ms. Annett Furman (POC) at Shockride, LLC DBA ArmorWorks. Triman Industries, Inc. will provide a proposal within 30 days.
Information received regarding the commerciality of the item(s): Shockride, LLC DBA ArmorWorks stated via email the item is not commercial. Triman Industries, Inc. also stated the item is not commercial in there completed market survey. Shockride, LLC DBA ArmorWorks Supplies and Triman Industries, Inc. did not

2.101 & 3.104) provide any supportable commercial documentation. The item is not commercial. The item is not modified of a type available in the commercial market place and does not have minor modifications of a type not customarily available in the commercial market place. Based on this information FAR 15 will be utilized. In addition, there was no information available from Google, Amazon, or EBay to support commerciality.
9. Additional facts supporting other than full and open competition are:
(X) Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
