SINGLE SOURCE DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP) UNDER THE
SIMPLIFIED ACQUISITION THRESHOLD (SAT)
AUTHORITY: FAR 13.106-1(b)(1)

1. Contracting activity/agency. Department of the Interior, Interior Business Center, Acquisition Services Directorate, Division 3, on behalf of Special Operations Command, South (SOCOM).
Requiring Activity:
2. Description of supplies or services required to meet agency needs.
The purpose of this contract is to acquire maintenance and repair services for Solaris Oracle server operating systems. The customer is in the process of transitioning to a new Global Command and Control Systems-Joint (GCCS-J) System. At the end of the transition period, all the Oracle equipment will be de-militarized and turned in for destruction. The customer needs maintenance and repair services of the current equipment until the new GCCS-J System is fully operational in the next two to three years. The effort requires the current technicians supporting this requirement, as they are cleared to work on these classified systems.
The estimated period of performance and pricing is listed below:
Base Year: 12 April 2020 - 11 April 2021, Option Year 1: 12 April 2021 - 11 April 2022, Option Year 2: 12 April 2022 - 11 April 2023,
3. Identification of the single source to be solicited.

4. Reason for authority cited. The contracting officer has determined the circumstances of the contract deem only one source reasonably available.
X Urgency – The nature of the requirement has been deemed urgent and following competitive procedures would result in unacceptable delays.

□ Brand Name – The particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. If the justification is to cover only the portion of the buy which is brand name, then it should so state; the approval level requirements will then only apply to that portion.
□ Industrial Mobilization
5. Rationale.
Current technicians supporting this requirement are all cleared to work on the classified systems. The incumbent, Dynamic Systems, has been supporting the requirement since inception five years ago, and established all SOCSOUTH Oracle Accounts with vital service call requirements. The original one-year contract for this service was issued competitively under contract GS-35F-0209R, order HHSP233201600185G, dated 31 May 2016. The follow-on contract was issued competitively under contract NNG15SC69B, order HHSP233201700009U, for a base and two option years, and expires 11 April 2020. Only two contractors competed for both orders. For this contract, the Government requires the contractor to have the necessary clearance to start the contract and continue maintenance of these systems on 12 April 2020, with no down time, after the previous order expires. The Government believes only the incumbent contractor holds the necessary clearances and is able to continue the requirement with no ramp up time to avoid a gap in service.
If SOCOM was required to select another contractor to perform these duties at the level of quality required, the replacement contractor personnel would have to be vetted and cleared to acquire required clearances to work these classified systems, and applicable Oracle unique accounts would have to be recreated for the new technicians. The new company would have to coordinate with Dynamic systems and Oracle to either delete SOCOM’s existing accounts or have Dynamic Systems relinquish them to the new company. The clearance and transition process can take several months. Additionally, if in the transition process there was an equipment failure, it could prevent SOCOM from meeting critical requirements set by Department of Defense (DOD). This would require SOCOM to answer to the Joint Staff and may cause them to lose their status and associated funding, equipment, and contractors. Selecting another contractor would result in a non-recoverable loss of system knowledge, an unacceptable gap in services and delay of progress towards getting both operating systems in sync, and would jeopardize SOCOM’s critical relationship with the DOD. The only viable option at this time to prevent lapse in service and avoid unnecessary risk is to award a noncompetitive contract to the incumbent contractor as a sole source to fully meet the Government’s needs.

6. Market Research.
Market research was conducted, and although other companies with similar equipment maintenance exist, savings of time and money will be received by using the existing repair and maintenance contacts on this classified system.
