About this file
This document is a justification and approval for other than full and open competition. The Department of the Interior Bureau of Reclamation seeks to renew Autodesk Computer-aided Design software licenses for use by approximately 4,500 users across bureaus. The licenses include 753 Architecture Engineering and Construction Collection licenses and 36 Product Design and Manufacturing Collection licenses. The Department utilizes Autodesk products which create file formats that are impossible or incomplete to fully convert to other formats. Conversion to alternative software such as Bentley MicroStation would be cost prohibitive due to training requirements and loss of productivity during transition. The solicitation will be open market as a small business set-aside, with responses due under Solicitation Number 140R8122Q0018 for the period of January 16, 2022 through January 15, 2023 at an estimated cost not to exceed.

WBR 1406.303-1 Template 1 (04/2021)
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION
In accordance with FAR 6.302 or FAR 13.501(a), the proposed contractual action is pursuant to the statutory authority identified in paragraph 4. This template is required for actions over the Simplified Acquisition Threshold (unless the procurement is acquired as a limited source IAW FAR 8.405-6 or is an Exception to Fair Opportunity IAW FAR 16.505(b)(2)).
1. Agency and Contracting Activity (FAR 6.303-2(b)(1)). The Department of the Interior (Department), Bureau of Reclamation (Reclamation), Acquisition and Assistance Operations Branch, Denver, Colorado.
2. Nature/Description of Action (FAR 6.303-2(b)(2)). This is a brand name requirement for Autodesk software licenses annual renewals. The requirement will be competed open market as a small business set aside.
3. Description of Supplies/Services (FAR 6.303-2(b)(3)). The Department has an annual requirement to renew Autodesk Computer-aided Design (CAD) software licenses. The period of performance will be January 16, 2022 through January 15, 2023 and the estimated cost is not to exceed .
4. Statutory Authority Permitting Other than Full and Open Competition (FAR 6.303- 2(b)(4)). (Check one)
Authority FAR Coverage Application 41 U.S.C. 1901 FAR 13.501 Only one responsible source using Simplified

5. Qualifications (FAR 6.303-2(b)(5)). DOI currently maintains 753 Architecture Engineering and Construction (AEC) Collection licenses and 36 Product Design and Manufacturing Collection (PDMC) licenses used by approximately

4,500 users across all Bureaus of the Department. Each Collection includes several CAD related software applications. Some applications are used daily, while others are used occasionally.
The family of Autodesk products create an application specific file format (*.dwg). The full conversion of this file format to other formats is either impossible or incomplete.
Additionally, Reclamation has an estimated 3 million+ drawings with the *.dwg format making conversion cost prohibitive.
Retraining the DOI end user and support workforce (estimated 4,500 total) would be cost prohibitive. As an example, an alternative to Autodesk would be Bentley MicroStation.
Training for a three-day Bentley MicroStation class would cost per user, (https://www.ledet.com/events?product_ids[]=1068). This amount does not include the cost of loss in productivity nor the cost of delays that may occur due to the learning curve.
Market research was conducted to find comparable software to meet the needs of the Department. Below is a sampling of Autodesk licenses the Department currently utilized and is looking to renew along with the comparable software from Bentley or other software found.
AEC sampling:

(04/2021)
PDMC sampling:
The Department utilizes 29 AEC Collection licenses and Bentley is only able to provide similar software to meet 16 of those software licenses. The Department also utilizes 16 PDMC licenses and Bentley is only able to provide similar software to meet 6 of those software licenses. Market research shows Autodesk software licenses are the only products that can meet all the needs of the government in the current *.dwg format used.
The Department has previously purchased Autodesk software licenses and these licenses are currently in the renewal phase. If the Department were to implement a new software it would be costly and would not provide the necessary support needed for the varying projects already in the CAD design process throughout the Department.
6. Description of efforts made to maximize competition (FAR 6.303-2(b)(6)).
Reclamation posted a pre-solicitation notice with a small business set aside to the government point of entry (GPE) to notify prospective small business vendors of this solicitation in the coming weeks and to ensure maximal competition. A nearly identical, effort from FY21, 140R8121P0008, received 11 quotes under a small business set-aside.
Reclamation will compete this requirement open market as a total small business set aside given the pre- n.
7. Determination of Fair and Reasonable Cost (FAR 6.303-2(b)(7)). The Contracting Officer will perform necessary price analysis of all responses to the solicitation based on adequate competition. However, additional price analysis techniques such as market analysis for similar items in the industry and review of current price lists or catalogs will be employed, if deemed necessary in further assuring that the government will receive the best value for its dollars.

8. Description of Market Research Conducted (FAR 6.303-2(b)(8)). Market research was conducted and found similar software licenses. However, the market research showed that no solution provided the vast array of CAD applications required by the Department (as shown in Paragraph 5).
9. Any Other Supporting Facts (FAR 6.303-2(b)(9)). N/A
10. Listing of Interested Sources (FAR 6.303-2(b)(10)). identical requirement for Department-wide Autodesk licenses, 140R8121P0008, had a total of 11 small business quotes.
The 11 small business quotes were from: M2 Technologies, TopCon, CADD, New Tech, vCloud, Quadyster, NXGN, WiseCom, Technologist, Lotus USA, Blue Source. Reclamation is issuing a pre-solicitation notice on SAM.gov and it is reasonable to believe the same sources will be interested in this year's solicitation.
11. Actions Taken to Remove Barriers to Competition (FAR 6.303-2(b)(11)). In the past Autodesk licenses were only available for purchase through a single vendor (Autodesk).
Autodesk limited the number of authorized resellers for government customers. Due to this, Reclamation conducted annual market research and found that in 2017 Autodesk expanded their vendor pool to two GSA vendors. One vendor was small and the other large. The Bureau of Reclamation competed a BPA amongst both vendors due to expire in 2023. However, due to Autodesk increasing their license pricing and Reclamation conducting annual market research, it was found that resoliciting to award a new purchase order is in the best interest of the government. Autodesk has authorized more small business vendors to re-sell licenses. Therefore, Reclamation will compete this requirement as an open market small business set-aside and will continue to monitor the market for brands to recommend to the Department for consideration.
