About this file

This justification and approval document concerns the award of a contract modification to National Steel and Shipbuilding Company (NASSCO) to perform full blast, metal repairs and painting of fuel oil service tanks on board the USS SAMPSON. The Puget Sound Naval Shipyard and Intermediate Maintenance Facility seeks to add this work item under contract change 106N in support of the USS SAMPSON's Selected Restricted Availability. A paint peeling condition was discovered in the two fuel oil service tanks that could lead to subsequent fuel filter blockage and loss of propulsion if not addressed during the availability. NASSCO is currently performing extensive repairs and maintenance on the USS SAMPSON under the base contract, and the Navy has an urgent need to award this new work item to NASSCO in order to meet strict deadlines for completion of work during the availability window without soliciting competition.

DEPARTMENT OF THE NAVY

PUGET SOUND NAVAL SHIPYARD

AND INTERMEDIATE MAINTENANCE FACILITY

1400 FARRAGUT AVENUE STOP 2090

BREMERTON WASHINGTON 98314-2090 IN REPLY REFER TO:

J&A No. 23-33JA

JUSTIFICATION AND APPROVAL

FUEL OIL SERVICE TANKS (FOST) RCC 106N

1. Contracting Activity.

Puget Sound Naval Shipyard and IMF, Northwest Regional Maintenance Center (NWRMC), Contracts Department (Code 423), Everett, WA 98207.

2. Description of the Action Being Approved.

Award a contract modification in support the USS SAMPSON Selected Restricted Availability (SRA). RCC 106N adds work item 123-11-500 for Fuel Oil Service Tank, preserve, repair and paint.

3. Description of Supplies/Services.

The proposed action is to add out of scope request for contract change 106N to the USS SAMPSON SRA to provide full blast, metal repairs and painting of fuel oil service tanks and , estimated cost of using FY23 OPN funding.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(2), Unusual and compelling urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

NASSCO is currently providing extensive repairs and maintenance on the USS SAMPSON and the U.S. Navy has an immediate need to support its availability to accomplish maintenance and repairs.

The Contracting Officer determined that, in order to meet strict deadlines for the availability of work on the ship, it’s in the best interest to award NASSCO this new work item rather than soliciting to another contractor. The new work Addition does not impact current availability Key Events or Milestones. Schedule

J&A No. 23-33JA integration is required. This work is required to correct a paint peeling condition found in the two fuel oil service tanks.

If not corrected during this availability, paint delamination will cause subsequent fuel filter blockage because these tanks receive fuel that is purified prior to entering the tanks. This condition will cause fuel starvation to the ships main engines and cause loss of propulsion while underway if paint chips delaminate and enters the fuel delivery system to the main engines. The paint delamination condition was discovered during routine open and inspect. Subsequent inspection by C/242 project support engineer determined the need for this repair effort.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A synopsis of the proposed modification was not published to SAM.gov due to the exception at FAR 5.202(a)(2) for unusual and compelling urgency. The base contract was a sole source award to NASSCO using industrial mobilization as its authority. Maintaining the industrial base is critical to national security given the limited number of contractors available to perform the work in the Pacific Northwest.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, PSNS & IMF/NWRMC has no plans at this time to compete future out of scope modification for the types of supplies/services covered by this document. If another potential source emerges, PSNS & IMF/NWRMC will assess whether competition for future requirements is feasible.
