JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1.

IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED:

The requiring activity is the Defense Security Service, 1340 Braddock Place, Alexandria, VA 22314 The contracting activity is the General Services Administration, Federal Acquisition Service, Mid-Atlantic Region, Philadelphia, PA 19107 2.

NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

The action being approved is a sole source purchase for Maintenance and Support for four (4) Sunrise S3500 Microfiche Scanners.

3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED:

Maintenance and support for (4) SunRise Microfiche Scanners is required.

Serial Numbers: BU3000RS0607051B, BU3000RS0607031B, BU3000RS0607021B, BU3000RS0607011B.

EMA Standard support includes 8 hours on site response, 5 X 9 hours of coverage, Monday through Friday, (2) Preventive maintenance visits, and Risk Free policy.

This support must come from an authorized SunRise Maintenance provider and using genuine Sunrise Imaging parts.

Estimated value of this procurement is $30,000 3.

IDENTIFICATION OF STATUTORY AUTHORITY:

6.302-1(a)(2)(ii) – Only one responsible source and no other supplies or services will satisfy agency requirements and will cause unacceptable delays in fulfilling the agency’s requirement.

DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED:

This determination was decided on the following research factors:

1). Ash Jain, SunRise Imaging representative, provided a statement that only an authorized reseller/service provided can provide maintenance on SunRise Scanners. Imaging 411 is the National Distributor for Sunrise products and are responsible for all the service of SunRise products in the USA. Only Imaging 411 can train and certify other service providers for SunRise Products.

2). Market research via the World Wide Web and GSA eLibrary supports the determination that Imaging 411 is the sole source for this product. A formal Synopsis will be posted in FEDBIZOPPS to give contractors an opportunity to express interest or identify capabilities that provide the required support, and maintenance.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.

Support must be obtained from an authorized SunRise Maintenance provider, using genuine Sunrise Imaging parts to uphold the manufacturer’s warranty of the product.

In addition, the requiring agency’s need for continued reliability and standardization of the SunRise Scanner Support lead to lower maintenance costs and minimized downtime due to lower training and troubleshooting costs attributable to standard diagnostics, configuration and support. This is especially true of Information Technology products and services where the risk of increased cost (at an exponential rate) is very high in the face of any downtime. Thus, the purchase of this maintenance and support is justified as an agency’s mission is vastly dependent on the reliability of its technology support operations. The use of any other service provider at this time has the potential to harm the Government by causing severe disruption of interoperability and greatly increasing the chances for impeding the agency’s mission and the security of its workforce.

6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE

A formal Synopsis will be posted in FEDBIZOPPS for five (5) days to give contractors an opportunity to express interest or identify capabilities that provide the required support and maintenance.

7. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND

REASONABLE:

Fair and reasonable pricing determination will be based upon the following: the manufacturer’s published price list, comparison to an independent Government estimate and comparison to previous contractor sales to Government agencies.

8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED

Market Research was conducted via GSA elibrary, The World Wide Web, historical procurement information, and communication with the manufacturer, SunRise Imaging.

GSA Region 3 has purchased this annual maintenance and support for DSS in April of 2007 for the same standard maintenance and support, under ITSS control ID # R3073345. The price at that time was $7500.00 each for one year of service.

This was also an Open Market procurement for commercially available scanner maintenance which resulted in a firm fixed price delivery order issued to Imaging 411, Inc.

9. ANY FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

10. A LISTING OF SOURCES THAT EXPRESSED AN INTEREST IN THE ACQUISITION

11. A STATEMENT OF ACTION THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION

If future expenditures and allowances are granted for continued PIV support, all efforts will be made by the government to aggressively seek alternate sources for hardware and software. Agencies also need to monitor software product developments and changes in the marketplace so that they have greater awareness of product availability and interoperability.
