This is a Combined Synopsis/Solicitation for Commercial Items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. The Request for Quotation (RFQ) R17PS00074 will be issued simultaneously with this announcement to facilitate receipt of electronic quotes and to view all applicable clauses and attachments.

The Bureau of Reclamation, Yuma Area Office, Yuma, Arizona has a requirement for bulk of chemicals to include Anhydrous Ammonia, Hydrated Lime, Liquid Chlorine, and Liquid Ferric Sulfate for the Yuma Desalting Plant (YDP). Award will be made to the lowest responsible, responsive offeror.

The RFQ will be issued via www.fedbizops.gov and may also be found at www.fedconnect.net. This RFQ is issued under Simplified Acquisition Procedures (SAP), and is being issued as a Total Small Business set-aside; however large businesses are encouraged to quote in the event that responsive small business quotes are not received. For this acquisition, the North American Industrial Classification System Code (NAICS) is 325998 All Other Miscellaneous Chemical Product and Preparation Manufacturing and the Small Business Size Standard is 500 employees.

The RFQ contains the following: a description with quantities, Specifications and all applicable clauses and provisions. Hard copies of this RFQ will not be available. Quotes are due on December 6, 2016 at 5:00pm (Eastern Time). All responsible sources may submit a quote which, if timely received, shall be considered.

Quotes must be submitted electronically.

All interested parties are responsible for checking the FBO website to ensure that they have the most current information. Offerors are required to have a current registration in the System for Award Management (SAM) to be eligible for contract award. Offerors may register in SAM at http://www.sam.gov.

(a) The contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such fraud, waste, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(b) The contractor shall notify employees that the prohibition and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect.

(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(d)(1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the contractor is not in compliance with the provisions of this clause.

(2) The Government may seek any available remedies in the event the contractor fails to comply with the provisions of this clause.

C.3 52.211-16 VARIATION IN QUANTITY APR 1984

(a) A variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping, or packing, or allowances in manufacturing processes, and then only to the extent, if any, specified in paragraph (b) of this clause.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Internet Payment Platform System (IPP).

“Payment requests” means any request for contract financing payment or invoicing payment by the Contractor. Specifications

The following specifications are for bulk chemicals for the Yuma Desalting Plant potable water system.

Anhydrous Ammonia. The anhydrous ammonia shall meet specifications contained in AWWA B305-15, Standard for Anhydrous Ammonia. This material shall be certified as suitable for contact with or treatment of drinking water by an accredited certification organization in accordance with ANSI/NSF Standard 60, Drinking Water Treatment Chemicals – Health Effects. The Anhydrous Ammonia shall be delivered in 150-pound cylinders.

Hydrated Lime. The hydrated lime shall meet specification contained in ANSI/AWWA B202-07, Standard for Quicklime & Hydrated Lime.

The hydrated lime shall be delivered by truck with pneumatic unloading capabilities with blower. The bagged hydrated lime will be delivered in 50-pound bags. Payment will be made for actual delivery in accordance with 52.211-16 Variation in Quantity.

This material shall be certified as suitable for contact with or treatment of drinking water by an accredited certification organization in accordance with ANSI/NSF Standard 60, Drinking Water Treatment Chemicals

– Health Effects.

Hydrated lime shall be high calcium, greater than 91 percent as calcium hydroxide. Insoluble matter shall be 3% or less. 80% of the hydrated lime shall pass through a 200-mesh sieve.

Liquid Chlorine. The liquid chlorine shall meet specifications contained in AWWA B301-04, Standard for Liquid Chlorine.

The liquid chlorine shall be delivered to the YDP by truck as required. The chlorine will be delivered in ten 1-ton containers.

This material shall be certified as suitable for contact with or treatment of drinking water by an accredited certification organization in accordance with ANSI/NSF Standard 60, Drinking Water Treatment Chemicals

– Health Effects.

Liquid Ferric Sulfate. The liquid ferric sulfate shall meet the specifications contained in AWWA B406-06, Standard for Ferric Sulfate.

The liquid ferric sulfate shall be delivered to the YDP by truck capabilities. Payment will be made for actual delivery in accordance with 52.211-16 Variation in Quantity.

The liquid ferric sulfate shall be a minimum of 50%, by weight, ferric sulfate.

This material shall be certified as suitable for contact with or treatment of drinking water by an accredited certification organization in accordance with ANSI/NSF Standard 60, Drinking Water Treatment Chemicals

– Health Effects.

Sulfuric Acid. The concentrated sulfuric acid shall be delivered to the YDP by truck. Payment will be made for actual delivery in accordance with 52.211-16 Variation in Quantity.

The concentrated sulfuric acid shall be 66o Baume, 93% or greater as hydrogen sulfate. Delivery shall be by truck. The supplier is responsible for meeting all applicable Department of Transportation (DOT) regulations regarding transportation.

Shipping/Delivery Requirements

The supplier is responsible for meeting all applicable Department of Transportation (DOT) regulations to include Title 49 CFR (if applicable) regarding transportation of anhydrous ammonia, lime, liquid chlorine, liquid ferric sulfate and sulfuric acid.

The supplier shall furnish a copy of the information required by OSHA Form 20 Material Safety Data Sheet with each delivery.

All deliveries shall have a Bill of Lading containing the following minimum information:

1. Name of contractor,

2. Quantity delivered,

3. Date of delivery and;

4. Signature of receiving representative.

Deliveries of all bulk chemicals shall be during normal business hours Monday through Friday from 7:30 a.m. to 4:00 p.m. (excluding Federal Holidays) and made to:

E.3 52.212-2 EVALUATION – COMMERCIAL ITEMS OCT 2014

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) technical capability of the item offered to meet the Government requirement; and

(ii) price;

Award will be made to the lowest responsible, responsive offeror. The offeror shall submit a copy of the HazCom Global Harmonization Systems (GHS) Safety Data Sheets with their quote.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub.
