TECHNICAL FACTS SUPPORTING A REQUEST TO ENTER INTO AN ACQUISITION WHICH

PRECLUDES CONSIDERATION OF A PRODUCT MANUFACTURED BY ANOTHER COMPANY

Project Name: Mace equipment for FMTRS-Refuge, FMTRS-Vanderslice, and FMTNV

Pursuant to Federal Acquisition Regulation (FAR) 11.105 and 6.302, for purchases of items peculiar to one manufacturer, Agency requirements shall not be written so as to require a particular brand-name, product, or a feature of a product, peculiar to one manufacturer, unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs; the authority to contract without providing for full and open competition is supported by the required justifications and approvals in accordance with FAR 6.302-1, or the basis for not providing for maximum practicable competition is documented in the file (see 13.106-1(b)) or justified

(see 13.501) when the acquisition is awarded using simplified acquisition procedures; and the documentation or justification is posted for acquisitions over $25,000 (see 5.102(a)(6))

2. Nature/Description of Action.

This requirement is for the purchase of MACE sensors that allows us to upgrade the existing sensors to a higher quality source of data and to replace sensors currently deployed that have been damaged. MACE ultrasonic insertion velocity sensors use Doppler technology to measure suspended solids in water, along with temperature, returning a velocity with great accuracy. This data is sufficient in our data collection process.

5. Demonstration of Contractor’s Unique Qualifications.

This equipment offers an internal power source to ensure data collection is does not cease in the event of a power outage. MACE is also the only one that offers the remote access feature.

Many other manufactures’ equipment is found to be incompatible with our current data collection processes and/or telemetry system. We currently have MACE sensors deployed in the field.

6. Description of efforts made to maximize competition.

Extensive market research was been performed and comparable product information was collected. In this research it was found that the similar products were found to be incompatible with our current telemetry system, or does not meet the technical requirements.

7. Determination of Fair and Reasonable Cost.

Extensive market research has been performed and is comparable with similar pieces of equipment, MACE appears to be a reasonably priced sensor meeting all of the requirements of the mission, along with an accuracy of ±1%.

8. Description of Market Research.

McCrometer equipment is found to be incompatible with our current data collection processes and/or telemetry system as analog outputs can no longer be integrated. There is no remote access feature, nor is there an option for internal memory storage. Though competitively priced, the McCrometer sensors have zero stability from 0.3 to 32 ft/s (normal operating ranges) and do not appear to be a reliable source of data collection.

Teledyne equipment also cannot be remotely accessed. The minimum pipe diameter for successful operation of the Teledyne ADFM sensor is 18 inches and does not meet the demand for the 12 in. pipes being upgraded. Communication cables from the datalogger to the Teledyne sensor are only available up to 100 feet and will not be sufficient for the required 160 feet. Teledyne ADFM sensors are expensive.

9. Any Other Supporting Facts.

This equipment is needed to keep up with data collection and integrity of stringent water accounting standards. The simplicity and quality of this device has proven to be satisfactory.

In our research, we have not found another manufacturer of this type of device that meets the acceptable quality of data, which is a requirement of Reclamation to comply with water accounting demands and are compatible with the existing equipment already in use.
