JUSTIFICATION AND APPROVAL

USTRANSCOM JUSTIFICATION FOR AN

EXCEPTION TO FAIR OPPORTUNITY

AFGHAN FIXED WING SEQUEL

HTC711-10-D-R018

1. CONTRACTING ACTIVITY.

United States Transportation Command, Directorate of Acquisition, Transportation Support Branch, 508 Scott Drive, Building 1900W, Scott AFB, IL 62225-5357.

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

United States Special Operations Command (USSOCOM) requires continued support for fixed wing air transportation services in the CENTCOM AOR. USTRANSCOM was notified that the customer has changes to the requirements, causing a delay in the recompete of the current contract. This justification for a logical follow-on supports award of a task order for up to six additional months in accordance with Federal Acquisition Regulation (FAR) 16.505 (b)(2)(i)(c).

The current Period of Performance (PoP) on the contract expires 30 November 2015, all options and the option to extend services per FAR Clause 52.217-8 have been exercised. A task order with one three-month base period and three one-month options (1 December 2015 through 31 May 2016) is needed while the customer redefines the requirement and a new contract is awarded to prevent an interruption of services which would result in a negative mission impact in a contingency environment.

3. DESCRIPTION OF THE SERVICES REQUIRED TO MEET THE AGENCY'S

NEEDS (INCLUDING ESTIMATED VALUE).

An extension of the contract will provide the USSOCOM with the services needed to maintain current and future operations. USSOCOM requires three (3) fixed wing aircraft for the movement of passengers and cargo. Aircraft used to satisfy this requirement must be capable of performing Short Take-Off and Landing (STOL) with combination passenger and cargo commercial charter aircraft as well as casualty evacuation services. Specific mission operating locations include Afghanistan, Kyrgyzstan, Tajikistan, Uzbekistan, and Pakistan. All planes must be multi-engine and operated by two pilots. The aircraft are required to be positioned at Bagram Airfield in Afghanistan to complete missions occurring on or after 1 Dec 2015. Using historical data from the same time frame last year, the missions during this extension will support 7,722 passengers and 921,392 pounds of cargo.

Specifically, a Task Order will be awarded for three (3) months, with three one-month options to allow for revisions to the requiring agency's requirement and source selection.

4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY AND

SUPPORTING RATIONALE.

The exception to fair opportunity for this justification is Federal Acquisition Regulation (FAR)

16.505 (b)(2)(i)(c), which reads "the order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided all awardees were given a fair opportunity to be considered for the original award."

The customer notified USTRANSCOM for the need of continued services and a new contract has been in development. On 9 November 2015, USSOCOM notified USTRANSCOM that changes to the requirement are forthcoming. The requirement changes are anticipated to necessitate adjustments to the evaluation criteria and as well as possibly impacting an offeror's technical approach. Continued services are necessary to prevent any break in service, which is unacceptable for the warfighter.

The task order was solicited and competed among the multiple-award IDIQ contract holders.

Berry Aviation received the award for the current services (Task Order 0002). Berry Aviation is the only contractor which currently has sufficient aircraft positioned at Bagram Airfield to fulfill this requirement without delay and without start up or positioning costs. Therefore, in the interest of economy and efficiency award of a new task order to Berry Aviation is a logical follow-on to an order already issued under the contract.

Organic fixed wing assets are not available to accomplish troop movement and resupply missions. Therefore, contracted support is the only option. Current missions are a necessity.

With a lapse in performance, the war fighter needs would not be met and would result in implications with a global impact.When the revised requirement is received, it will be competed on a full and open basis.

5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

The base year and option year prices to provide fixed wing services under the current contract were determined fair and reasonable at the time of award based on adequate competition from seven (7) offerors. This historical pricing provided the baseline for the government estimate for the new Task Order, therefore the anticipated costs are determined to be fair and reasonable.

6. OTHER FACTS SUPPORTING THE JUSTIFICATION.

7. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.

Upon receipt of the revised requirement, USTRANSCOM will procure the requested services using full and open competition for the follow-on acquisition. Therefore no further actions are necessary to remove barriers to competition for future actions.
