Performance Work Statement

New Orleans VA Elevator Maintenance & Repair

Southeast Louisiana Veterans Health Care System

New Orleans Replacement Facility

GENERAL INFORMATION

The purpose of this service contract is to provide the New Orleans VA Medical Center Campus with continual maintenance and repair of freight and personnel elevators. There will be a total of 15 buildings on the campus required under this contract.

1. Project Title New Orleans VA Elevator Maintenance and Repair

2. Project Background

2.1. The vertical transport system located at 2400 Canal St.consists of Kone and Thyssen Krupp elevators. These elevators are currently housed in the following buildings: Pan American Building (also designated as Building Q), Outpatient (H and J), Central Energy Plant (N), Patient Garage (L), Inpatient (B and C), Diagnostic and Treatment (D, E, F, G), Transitional Living (M), Staff Garage (K), Research (P), and Fisher House (S).

3. Scope of Work

3.1. The contractor shall provide all parts, travel, labor and materials necessary to provide maintenance, repair services, and preventative maintenance and service calls described herein on the elevators, controls, subsequent parts and systems, etc. located at 2400 Canal St., New Orleans, LA. The Contractor will be responsible for providing all background paperwork certifying part installation and/or repair, calibration, testing of the systems, and certifications of maintenance. Contractor shall also provide an extended warranty on all applicable parts and equipment for the systems. All preventative maintenance work shall be in strict adherence to the recommended manufacturer’s specifications and standard operating procedures for equipment maintenance. The elevator types and estimated quantities are as follows:

3.7. All work shall be performed by personnel specifically qualified and trained to work on the vertical transport systems, specifically elevator cars, controls, equipment, etc. described herein. Evidence of all required licenses, as well as documentation of qualifications of personnel, shall be provided to the Contracting Officer (CO) prior to award of contract.

4. Performance Objectives

4.1 Contracted elevator maintenance provider shall perform all inspections, testing, repairs and preventive maintenance of the facility’s elevators to keep said system in compliance with the most current edition of National Fire Protection Association (NFPA) Life Safety Code, National Electric Code (NEC), American Society of Mechanical Engineers (ASME), American National Standard Institute (ANSI), and other Federal Regulations pertaining to Vertrical Transport systems in medical and Federal facilities.

Period of Performance

4.2. The period of performance shall run from on or around May 20, 2021 through May 19, 2022. Should these dates change, the Contracting Officer will issue a modification to the contract reflecting the corrected date. The Contractor is required to proceed as originally scheduled until such modification is issued. The Contracting Officer is the only official authorized to make changes to the contract.

Key Personnel

4.3. The Contractor shall submit a list of the points of contact for VA’s account pertaining to maintenance, testing, and service calls. Submission shall include the person’s name, phone number, email and address for correspondence. For all work completed, the Contractor shall submit proof of elevator maintenance and testing certification for the technician completing the work.

Type of Contract

4.4. This contract shall be a Firm Fixed Price Contract.

Place of Performance

4.5. The work shall initially be performed at the New Orleans VA Medical Center site located at 2400 Canal St. New Orleans, Louisiana. As additional buildings are turned over to the Department of Veterans Affairs for use and as systems exit their warranty periods, the remaining buildings and associated equipment shall be scheduled via task order.

COR Authority

4.6. In no event is the Contracting Officer’s Representative (COR) empowered to change any of the terms and conditions of the contract. All changes, to any section of this contract, shall be made only by the Contracting Officer pursuant to a properly executed modification. The types of actions within the purview of the COR’s authority are to ensure that the Contractor performs the technical requirements of the contract, and to notify the Contracting Officer of any deficiencies observed. A Letter of Designation shall be issued to the COR and a copy shall be sent to the Contractor at the time of contract kickoff meeting or post-award conference setting forth in full the responsibilities and limitations of the COR.

Hours of Work

4.7. Normal operational hours for the VA facilities are from 7:30 a. m. – 4:30 p. m, Monday through Friday, exclusive of Federal Holidays. Services performed by the contractor during all other times shall be considered to be overtime emergency call-back service.

Contract Award Meeting

4.8. The Contractor shall not commence performance on this contract until the Government has conducted a contract kickoff meeting, post-award conference or the COR has advised the Contractor that a kickoff meeting is waived. The following item shall be delivered as part of the initial contract kickoff and submitted either at the kickoff meeting (one electronic and one hard copy) or emailed to the CO should the meeting be waived: Quality Assurance Surveillance Plan (QASP).

5. General Requirements

5.1. All written deliverables shall be phrased in layperson language. Statistical and other technical terminology shall not be used without providing a glossary of terms.

5.2. The Contractors shall furnish all labor, transportation, equipment, materials, tools, supplies, supervision, incidental engineering, and management required to perform the maintenance, repair and component replacement as required to maintain the designated elevators in accordance with the manufacturer's original specifications. Equipment systems covered under this contract are listed in Attachment #1. Work includes the performance of service work, preventative maintenance of equipment and other services as described herein.

5.3. Work Excluded. The subparagraphs below further clarify the scope of work under this contract:

5.3.1. Improvements. Installation of new or improved equipment of modifications to existing equipment as directed or required by authorities cognizant of this contract, is not included in this contract. Improvements also cover work not necessary as part of maintenance and repair.

5.3.2. Cleaning and Refinishing. Work covering routine cleaning and refinishing of the interior of cars and the exterior of hoistway doors and frames is not included in this contract. However, cleaning of equipment spaces and daily cleanup of job sites in conjunction with preventative maintenance, inspection services, and repairs are included in this contract.

5.3.3. Warranted Equipment. Equipment, components, and parts, other than that installed under the contract, shall not be removed or replaced or deficiencies corrected while still under warranty of the manufacturer or the installer without prior approval of the COR. All defects in materials or workmanship, defective parts, or improper installation and adjustments found by the Contractor shall be reported to the COR so that necessary action may be taken. The Contractor shall be knowledgeable of the equipment, parts, and components that are covered by warranty and the duration of such warranties. Available warranty information will be furnished to the Contractor by the COR.

5.4. Licensing and Supervision. The Contractor shall be licensed by the State of Louisiana to provide the maintenance and repair services specified in this contract. All work shall be performed by elevator mechanics specifically qualified and trained to work on elevator, escalator, dumbwaiter, cart lift systems and equipment. Evidence of all required licenses, as well as documentation of the qualifications of personnel, shall be provided to the CO and COR prior to award of the contract.

5.5. DEFINTIONS- TECHNICAL. As used throughout this contract, the following terms shall have the meaning set forth below. Additional definitions are in the "DEFINITIONS" clause.

5.5.1. Where “as shown”, “as indicated”, “as detailed”’ or words of similar import are used, it shall be understood that reference is made to this specification and the drawings accompanying this specification unless stated otherwise.

5.5.2. Where “as directed”, “as required”, “as permitted”, “approval”, “acceptance”, or words of similar import are used, it shall be understood that direction, requirement, permission, approval, or acceptance of the COR is intended unless stated otherwise.

5.5.3. DEFINTIONS- TECHNICAL. As used throughout this contract, the following terms shall have the meaning set forth below. Additional definitions are in the "DEFINITIONS" clause.

5.5.6. ANSI. The abbreviation of the American National Standard Institute.

5.5.7. Adjust. To regulate, settle, bring to a more satisfactory state of normal operating condition.

5.5.8. Check. Examine, inspect, test, or verify by trail.

5.5.9. Component Part. Any part of any item or system which is detachable or removable from the main body or main assembly of the item or system; a constituent part or an essential part necessary to the performance of the system.

5.5.10. Contractor. The term contractor as used herein refers to both the prime Contractor and any subcontractors. The prime Contractor shall ensure that his/her subcontractors comply with the provisions of this contract.

5.5.11. Contractor Representative. A foreman or superintendent assigned in accordance with the “CONTRACTOR EMPLOYERS”.

5.5.12. Control. A mechanism used to regulate or guide the operation of a machine, apparatus, or system.

5.5.13. Emergency Work. Work requiring immediate action to correct or prevent loss or damage to Government property, or to eliminate hazards to personnel or equipment.

5.5.14. Frequency of Service.

5.5.14.1. Pentannual (P) – Services performed once every five years upon the last anniversary of the service. This may also define the completion of a service that is typically conducted once every five years. Example include “Five- Year Full Load Test” for elevator systems.

5.5.14.2. Annual (A) – Services performed once during each 12 month period of the contract.

5.5.14.3. Semi-annual (SA) – Services performed twice during each 12 month period of the contract at intervals of 160 to 200 calendar days.

5.5.14.4. Quarterly (Q)- Services performed four times during each 12 month period of the contract at intervals of 80 to 100 calendar days.

5.5.14.5. Monthly (M) – Services performed 12 times during each 12 month period of the contract at intervals of 28 to 31 calendar days.

5.5.14.6. Semimonthly (SM)- Services performed 24 times during each 12 month period of the contract at intervals of 14 to 16 calendar days.

5.5.15. Inspect. To examine thoroughly, to view closely in critical appraisal.

5.5.16. Maintain. To keep in a state of repair and efficiency, to preserve from failure or decline.

5.5.17. Maintenance. Work which is required to repair or maintain equipment systems in a safe, operational condition, or to restore these systems to initial or usable condition by overcoming the effects of wear and tear, disaster, damage, or deterioration. New construction or alteration is not included.

5.5.18. Provided. Shall be understood to mean provided in place, which is, furnished and installed, ready for use.

5.5.19. Quality Assurance (QA). A method used by the Government to provided some measure of control over the quality of purchase foods and services received.

5.5.20. Quality Control (QC). A method used by the Contractor to control the quality of goods and services produced.

5.5.21. Regular Working Hours. The Government's regular (normal) working hours are from 7:30am to 4:30 pm local time, Mondays through Fridays except (a) Federal Holidays and (b) other days specifically designated by the COR.

5.5.22. Repair. Repair is the restoration of a piece of equipment, a system, or a facility to such condition that it may be effectively utilized for its designated purposed. Repair, may be overhaul, reprocessing, or replacement of constituent parts or materials that have deteriorated by action of the elements or usage and have not been corrected through maintenance, or replacement of the entire unit or system if beyond economical repair.

5.5.23. Replace. To remove damaged, defective, or deteriorated materials or parts and install new or used materials or parts as approved.

5.5.24. Required. Demanded as necessary or essential to the satisfactory operation of the equipment or system.

5.5.25. Response Time. Response time is defined as the time allowed the Contractor after initial notification of a work requirement to be physically on the premises at the work site with appropriate tools, equipment, and materials, ready to perform the work require. Response times are designated in the appropriate technical clauses in the Section.

5.6. GOVERNMENT FURNISHED ITEMS. The Government will not provide office space and operational facilities to the Contractor. The Contractor shall secure and maintain the necessary office space and other facilities required for the performance of this contract at his/her own expense.

5.6.1. Government Furnished Equipment. The Contractor shall furnish all tools and equipment required for the performance of this contract. The Government will not provide tools or equipment to the Contractor.

5.6.2. Government Furnished Material. The Government will not provide any materials to the Contractor.

5.6.3. Availability of Utilities. The Government will furnish the following utility services at existing outlets, for use in those facilities provided by the Government and as may be required the work to be performed under the contract: electricity, natural gas, fresh water, sewage service, and refuse collection (from existing collection points). Information concerning the location of existing outlets may be obtained from the COR. The Contractor shall provide and maintain, at his/her expense, the necessary service lines from existing Government outlets to the site of work.

5.6.3.1. Utilities specified above will be furnished at no cost to the Contractor.

5.7. CONTRACTOR FUNISHED ITEMS. Except for the items listed in previous clauses, the Contractor shall provide all facilities, equipment, materials, and services to perform the requirements of this contract. The Contractor shall provide new or factory reconditioned parts and components when providing maintenance and repairs services as described herein. All replacement units, parts, components, and materials to be used in the maintenance, repair, and alteration of equipment shall be compatible with that existing equipment on which it is to be used; shall be of equal or better quality than original equipment specifications; shall conform to the technical specifications, and used in accordance with original design and manufacturer's intent. Items not listed in the technical specifications shall be of acceptable industrial grade and quality. It the original manufacturer has update the quality of parts for current production, parts supplied under this contract shall equal or exceed the updated quality. When disputes arise concerning material, equipment, and components selected for work items already accomplished, the Contractor shall, at no cost to the Government, remove, replace, and/or rework material, equipment, and components so that compliance with the Government's requirements are satisfied.

5.8. WORK OUTSIDE REGULAR HOURS. Except as may otherwise be specified, all work shall be performed during regular working hours. If the Contractor desires to carry on work on Saturday, Sunday, holidays, or outside regular working hours, he/she must submit application to the COR for approval.

5.9. MANAGEMENT. The Contractor shall manage the total work effort associated with the operations, maintenance, repair and all other services required herein to assure fully adequate and timely completion of these services. Included in the function are a full range of management duties including, but not limited to scheduling, report preparation, establishing and maintain records, and quality control. The Contractor shall provide an adequate staff of personnel with the necessary management expertise to assure the performance of the work in accordance with sound and efficient management practices.

5.9.1. Work Control. The Contractor shall implement all necessary work control procedures to ensure timely accomplishment of work requirements, as well as to permit tracking of work in progress. The Contractor shall plan and complete work requirements within the specified time limits and in conformance with the quality standards established here in. Verbal scheduling and status reports shall be provided when requested by the COR. The status of any item of work must be provided within two (2) hours of the inquiry during regular working hours, and within four (4) hours after regular working hours.

5.9.2. Work Schedule. The Contractor shall schedule and arrange work so as to cause the least interference with the normal occurrence of Government business and mission. In those cases where some interference may e essentially unavoidable, the Contractor shall make every effort to minimize the impact of interference, inconvenience, equipment downtime, interrupted service, customer discomfort, etc.

5.9.3. Records. Cumulative service records shall be kept for each system in the inventory shown in Attachment #1. A separate record file shall be established and kept up to date for each system. The Contractor shall submit proposed formats for each of the required records listed below for the COR's approval at least 15 calendar days prior to the start date of the contract.

5.9.3.1. The records shall cover the following work:

5.9.3.1.1. Preventative Maintenance Inspection and Service (PMIS) work;

5.9.3.1.2. Corrective Maintenace/Service work;

5.9.3.1.3. Inspection, Testing, and Certification work;

Service work

5.10. The Contractor shall include the following data in the appropriate record within two working days from the completion of the associated work items:

5.11. The date(s) when the service(s) was scheduled, stated and completed.

5.12. Name of the individual(s) who performed the services.

5.13. The nature and extent of all service and repair work performed, including: completed PMIS record cards; description of conditions and deficiencies found during any PMIS visits, and deficiencies remaining uncorrected during PMIS visits; work performed during inspections and tests, results of those inspections/test, and disposition of deficiencies found during inspection/test; and description of service work performed, including a brief description of material and parts used (including costs and quantities), and hours of labor expended.

5.14. Any other information the Contractor chooses to include in the records, at no additional cost to the Government.

All required records shall be made available to the Government for examination and reproduction upon request, and the original records shall be submitted to the COR within five (5) calendar days of expirations of the contract. All required records shall be maintained in a readable, complete, orderly, timely and accurate manner.

Work Completion Reports. The Contractor shall submit work completion reports to the COR within two (2) working days after completing each occurrence of service under this contract. These reports shall contain, as a minimum, the information described in items of subparagraphs of the aforementioned "Records" paragraph and as mentioned elsewhere in this PWS, and shall be signed and dated by the Contractor's Representative.

Staffing. The contractor shall continuously maintain an adequate staff with suitable management expertise to assure work is scheduled and completed in accordance with these specifications. The Contractor shall maintain an adequate craft work force to complete work in accordance with the time and quality standards specified.

Preventative Maintenance Inspection And Service. The Contractor shall perform Preventative Maintenance Inspection and Service (PMIS) work on all equipment systems covered under this contract. work shall consist of maintaining these systems in a safe, reliable, and satisfactory operating condition. All work shall comply with ASME A17.1 except as modified herein. The contractor shall provide all necessary services, parts and materials, and complete all repair requirements identified during the performance of a PMIS as part of PMIS. Excessive or repeated system breakdowns or deficiencies may be considered by the Government as an indication of unsatisfactory performance of PMIS by the contractor.

5.15. Scope. PMIS work includes periodic contractor operation, inspection, checks, adjustments, and maintenance of elevator systems necessary to ensure that each system complied with applicable VA, local, ASME, and manufacturers' standards of safety, reliability and satisfactory operating condition. PMIS work shall be performed in accordance with the appropriate PMIS checklist in Attachment #3 and 4. The intent of PMIS is to provide routine maintenance services that permit the early detection and correction of items that, if deficient or defective, would: (a) interfere with the normal effective operation of the elevator and dumbwaiter systems; (b) endanger life and/or property; or (c) involve high costs or long lead time for repair. PMIS work shall include, but not necessarily be limited to: comprehensive operational inspection and adjustments to insure the satisfactory functioning of machinery and controls, care speeds, leveling devices, care and hoistway doors, and safety edge mechanisms; detecting and correcting the causes of unusual noise or vibrations; manufacturers' recommended machinery lubrication; adjustments to bring system operation within the manufacturers' specifications; repairs including defective part and component replacements; equipment space housekeeping; equipment cleaning' changing burned-out indicate lamps; other services as required to maintain all systems at a safe and acceptable operating condition.

5.16. Frequency. Minimum acceptable frequencies for the accomplishment of PMIS services are indicated in Attachment #3. If the contractor decides that additional visits are necessary to ensure maintenance and safety, he/she shall provide the necessary work at no additional cost to the Government. Additional guidance concerning annual and pentannual testing are including in Attachment #4.

5.17. Contractor PMIS Schedule Submissions. The Contractor shall submit a details PMIS schedule to the COR for approval at least fifteen(15) calendar days prior to the start date of the contract. The schedule shall include, for each specific equipment system and PMIS listed in Attachment #3, the location (system number); work to be performed (e.g. monthly PMIS); and the week of the month that the PMIS will be performed. The Contractor shall schedule and perform PMIS on regular Government working days between the hours of 7:30AM and 4:30 PM. Once the Contractor's PMIS schedule is approved by the COR, PMIS shall be performed by the contractor without further authorization by the COR. The Contractor shall strictly adhere to the scheduled PMIS dates to facilitate Government verification of the work. If the Contractor finds it necessary to reschedule PMIS, a written request shall be made to the COR detailing the reasons for the proposed change at least five (5) working days prior to the originally scheduled PMIS date. No scheduled PMIS dates shall be changed without the prior written approval of the COR.

5.18. Check In Requirements. The Contractor's superintendent shall check in at a site designated by the COR prior to the commencement of work and at the completion of work each days that PMIS is to be performed, indicate the work, sites of work, and order of work that is schedule to be performed that day.

5.19. PMIS Records and Reports. See the "MANAGEMENT" clause of this Section for PMIS record keeping and work completion reporting requirements.

5.20. PMIS Work Quality Standards. The Contractor shall meet the following PMIS work quality standards:

5.20.1. PMIS Checklist work items satisfactorily accomplished; all internal and external components, parts, assemblies, and subassemblies forming a part of each elevator system or necessarily for its safe operation are inspected, adjusted, lubricated, repaired or replaced as necessary to insure system is functioning as designed. No unusual or objectionable machinery wear, noise or vibration.

5.20.2. Clean equipment areas/rooms. Guide rails, overhead sheaves and beams, counterweight frames, tops of cars, bottoms of platforms, elevator pits, and machine room floors shall be brushed clean and rubbish removed at least once a month. A complete cleaning of the entire installation including all machine room equipment, hoist-way equipment, machine room floors and walls, hoist-way walls, supporting structures, etc. shall be accomplished once per year. The Contractor shall furnish all necessary cleaning supplies, vacuum cleaners, etc.

5.20.3. All car speeds meet manufacturer's rate speeds.

5.20.4. All movable parts shall be properly lubricated. All sheave, machine and motor bearing and hoisting ropes shall be lubricated machine stuffing box and bearing on motor-operated brakes shall be repacked and gear cases and guide lubricators shall be refilled when required. Hydraulic fluid sufficient to maintain the best operating levels shall be furnished on all hydraulic elevators.

5.20.5. General adjustments shall be made as necessary. All hoisting ropes shall he examined and all the tension equalized. Whenever necessary to insure maintenance of adequate safety factors, all hoisting ropes run governor ropes shall be replaced. The exterior of the machinery and any other parts of the equipment subject to rust shall be kept properly painted and presentable at all times. 'The motor windings shall be kept free of rust and carbon dust. Flume shoe rollers and gibes shall be renewed as required to insure smooth, stable, and satisfactory operation.

5.20.6. All electrical wiring and conductors extending to elevators and dumbwaiters tram circuit breakers and main line switches in Machine rooms and tram outlets in the hoist-ways shall be repaired and/or replaced when required. Circuit breakers or main line switches, together with fuses for same, are excluded.

5.20.7. Smooth car movement, with no unusual or objectionable noise or vibration.

5.20.8. All leveling devices maintained and adjusted to permit cars to stop level with all floors/landings.

5.20.9. All doors and safety edges maintained and adjusted to operate at rated speeds and as per original equipment specifications.

5.20.10. All normal and emergency operating controls maintained and adjusted to be fully operational.

5.20.11. All lights and indicator lamps are operational.

5.20.12. All safety systems and mechanisms maintained in safe, operational condition.

5.20.13. All cables acceptable inter-lubricated and maintained within allowable limits of wear. Systems are "shut down" and COR is notified when worn or damaged cables are found.

INSPECTIONS, TESTING AND CERTIFICATION. All inspection and testing shall be performed in accordance with ASME A17.1 and ASME A17.2, except as modified herein, by an independent third party. Deficiencies discovered during testing shall be corrected by the contractor. Inspections that are conducted as part of preventative maintenance program shall be completed by the contractor and adhere to the directives noted herein as well as abide, at a minimum by the checklists noted in ATTACHMENT 3. The maintenance contractor shall tag the tested devices after the inspection and safety tests have been performed and certified by the contractor’s inspector.

5.21. In the case of the inspection of fire alarm devices that are tied to, connected or pertain to the elevator systems, the contractor shall provide one (1) technician to observe such testing and assist the VA provided fire alarm maintenance contractor or tester as needed. Testing schedules for fire alarm devices are estimated to occur quarterly.

SERVICE WORK. The contractor shall perform service work (service calls) as necessary to determine the cause of system and equipment malfunctions, eliminate the cause(s), and restore the system or equipment to satisfactory working condition. Excessive or repeated systems and equipment malfunctioning may be considered by the Government to be unsatisfactory performance of service work by the Contractor. The Contractor shall respond to all service calls, including those calls where the accomplishment of repairs is subsequently determined to be beyond the major repair limit established in the "GENERAL REQUIREMENTS" clause.

5.22. Service Call Reception. Authorized Government representatives will advise the Contractor by phone of all service call requests, received, both during and after regular working hours, as well as the classification of each call based on the definitions provided below. The contractor shall have adequate procedures for receiving and responding to service calls 24 hours per day, including weekends and holidays. A single local or toll free telephone number shall be provided by the Contractor for receipt of all service calls. All telephone calls shall be answered within thirty (30) seconds by an individual fully familiar with the Contract's work control procedures and the terms and conditions of this contract. Calls shall be considered received by the Contractor at the time and date the telephone call is placed.

5.23. Service Call Classifications. Service calls will be classified by the Government as either emergency or routine, and the following procedures shall apply. All service calls shall be covered under this contract unless the required service is a result of abuse or misuse by the Government.

5.24. Emergency Service Calls. Service calls will be classified as emergency at the discretion of the COR. Generally, calls will be classified as emergency when system failures constitute a danger to personnel, threaten to damage property, or threaten to disrupt activity operations and/or training missions. Examples include personnel "trapped" inside an elevator, a fire or electrical defect which could cause fire or shock, etc. The Contractor shall provided a mechanic at the site and on the job ready to service the elevator, escalator, or dumbwaiter within one(1) hour of receiving the call, 24 hours a day, 7 days a week. After beginning work, the Contractor shall continuously until the emergency situation is arrested. After arresting the emergency condition, any remaining work required to restore safe, continuous and reliable equipment operation shall be performed as a routine service call in accordance with the requirements specified in the follow paragraph. Such follow up work shall be considered part of the original service call.

5.25. Normal emergency call-back service times are between the hours of 7:30 a.m. and 4:30 p.m., Monday through Friday, exclusive of Federal Holidays. Services performed during all other times shall be considered to be overtime emergency call-back service. If regular time work must be carried over and contractor wishes to continue to work beyond the Medical Center normal hours of operation, authorization for overtime work must be obtained from the COR or designated representative before proceeding.

5.26. Any overtime emergency call-back services shall be included in the cost of this contract. Overtime period services are not expected to exceed an average of 15 hours, per technician, per month. Allocation for this cost shall be included in this contract. Any time accumlated that is expected to exceed this maximium amount (15 hours per technician or aggregate of 180 hours in one year), shall not be completed without written approval of the CO prior to beginning work. Time shall be quoted at time and material cost. For every task order issued against this contract, this time should be increased by 20% (3 hours, per techician, per month) The contractor shall demonstrate all aggregated time used toward this overtime maximum to demonstrate justification for this added cost should it arise.

5.27. The cost of all normal emergency call-back service for the base year and subsequent option years shall be included in the cost of this contract. The VA shall not be responsible for incidental charges, including, but not limited to: parking, tolls, mileage, phone, etc., on straight time or for overtime work.

5.28. Routine Service Calls. Service calls shall be classified as routine when the work does not qualify as an emergency call. The contractor shall respond to and begin work on routine service calls within twenty-four (24) hours after receipt of the call. For example, if a routine service call is received by the Contractor at 10:00 am on Tuesday, the Contractor must be at the job site no later than 10:00 am on Wednesday. If the call is received at 2:00 pm on Friday, the Contractor must be at the job site not later than 2:00 pm on the following Monday. Routine service work will normally be performed during the Government's regular working hours unless prior approval is received form the COR. Routine service calls shall be completed in accordance with the following standards:

5.29. If no single repair parts exceed $250.00 in cost, all repair and service work shall be carried to completion upon commencement of the work. Work shall be completed within two (2) working days from receipt of the call.

5.30. If any single repair part equals or exceeds $250.00 in cost, but is less than $750.00, the contractor will be allowed one working day to procure the part after receipt of the call. Work shall be completed within two working days after obtaining the part.

5.31. If any single repair part exceeds $750.00 in cost, the Contractor will be allowed three working days after receipt of the call to procure parts. work shall be completed within two working days after obtaining the part.

5.32. After procuring part(s), Contractor shall work continuously during regular hours until the repair is completed. If the contractor has not secured parts within the allowed time, then the Government reserves the right to (a) find a source for the part and require the Contractor to purchase the part from that source, or (b) to accomplish the work by other means at contractor expense, or (c) require the Contractor to obtain and provide documentation of price quotations and the date of expected availability of parts form at least two different commercial suppliers.

Service Records and Reports. See the "MANAGEMENT" clause of this Section for service work record keeping and work completion reporting requirements.

Service Work Quality Standards. The contractor shall meet the following service work quality standards:

5.33. All work, including repair and replacement parts, satisfies the recommendations and requirements of ASME A17.1 (Parts X and XII and other parts/rules further referenced therein)

5.34. Operational and other inspections and tests incidental to or arising from the replacement of certain parts and components are satisfactorily performed, as recommended or required by ASME A17.1.

5.35. Continuous progress and completion of the work resulting in safe, efficient, and reliable system condition that permits the restoration of system service.

5.36. Safe job site during progress of work. Clean job site upon completion of work.

5.37. Unserviceable parts and components removed from Government property unless directed otherwise by the COR.

In the event that VA modifies the elevator system during the maintenance contract period, Contractor shall be required to verify that the system, as newly modified or added, is consistent with the manufacturer’s requirements; any verification performed will be equitably adjusted under the Changes clause. The post contract modification or addition to the elevator system, in part or in whole, shall not void the continuing requirements under this contract. The contract will be equitably adjusted under the Changes clause for such additional performance.

The contractor shall conduct all research and provide all resources required to ensure a smooth transition from the incumbent maintenance and monitoring contractor, in accordance with the contract requirements should this occur.

6. Changes to Requirement

6.1. In the event that VA modifies the elevator system, in part or in whole, during the maintenance contract period, Contractor shall be required to verify that the system, as newly modified or added, is consistent with the manufacturer’s requirements; any verification performed will be equitably adjusted under the Changes clause. The post contract modification or addition to the elevator system shall not void the continuing requirements under this contract. The contract will be equitably adjusted under the Changes clause for such additional performance.

6.2. Any changes to this PWS shall be authorized and approved only through written correspondence from the CO. A copy of each change will be kept in a project folder along with all other products of the project. Costs incurred by the contractor through the actions of parties other than the CO shall be borne by the contractor.

7. Travel

7.1. The contractor is responsible for providing transportation/travel for all materials, supplies, personnel and all items needed for the duration of this contract unless stated otherwise elsewhere.

8. Government Responsibilities

8.1. The Government shall provide access to the facilities as necessary for maintenance and service calls and responses to commence. The VA Engineering, Safety or Police Services will also provide notification of any systems outages, testing or downtime to affected VA staff.

8.2. Removing Employees for Misconduct or Security Reasons. The Government may, at its sole discretion, direct the contractor to remove any contractor employee from U.S. VA/VHA facilities for misconduct or security reasons. Removal does not relieve the Contractor of the responsibility to continue providing the services required under any Contract awarded. The Contracting Officer will provide the contractor with a written explanation to support any request to remove an employee.

9. Contractor Personnel Requirements

9.1. All qualified, experience, and license personnel for the service will be provided by the contractor. All Elevator Technicians shall be ASME QEI-1 certified to perform maintenance, testing and general repair on vertical transport systems. Proof of personnel experience shall be provided by the Contractor to the VA to include, but is not limited to: certification for maintenance and service on same or similar equipment described herein, past experience of no fewer than three years of working on systems similar in size and scope of the system listed here. Technicians modifying the elevator controls shall be factory trained and currently certified for the operating system, including software version, of the particular controls system, and shall provide documentation of this certification.

9.2. No portion of the work shall be subcontracted without prior written consent of the Contracting Officer. In the event that the contractor desires to subcontract some part of the work specified herein, the contractor shall furnish the Contracting Officer with the names, qualifications and experience of their proposed subcontractor(s). The contractor shall, however, remain fully liable and responsible for the work to be done by his subcontractor(s) and shall assure compliance with all requirements of the contract.

9.3. Contractor employees shall present a professional appearance at all times and their conduct shall not reflect discredit upon the United States and or the VA/Veterans Health Administration (VHA).

9.4. Conflict of Interest. The contractor shall not employ any person who is an employee of the United States Government if that employment would appear to cause a conflict of interest.

9.5. Uniforms. The contractor shall require all employees, including supervisors, to wear distinctive uniforms or clothing for easy identification, and assure that every employee is in uniform or clothing no later than the time specified by the COR, or otherwise no later than ten (10) working days from the date an employee first enters on duty. The uniform or clothing shall have the contractor's name, easily identifiable, affixed thereon in a permanent or semi-permanent manner, such as a badge or monogram.

9.6. Smoking: Employees are strictly prohibited from smoking anywhere in medical center buildings.

9.7. Supervision of Employees: The contractor shall be responsible for all means, methods, techniques, sequences and procedures, and for coordinating all portions of the work under the contract except where otherwise specified in the contract documents. The contractor shall, at all times, enforce strict discipline and good order among the workers, and shall not employ on the work any unfit person or anyone not skilled in the work assigned to him/her.

10. Protection of Person and Property

10.1. The contractor expressly undertakes’, both directly and through its subcontractor(s), to take every precaution at all times for the protection of persons and property, including Medical Center employees and property and its own.

10.2. The contractor shall be responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the work.

10.3. The contractor shall continuously maintain adequate protection of all work from damage and shall protect the Medical Center property from injury of loss arising in connection with this contract. The contractor shall make good any such damage, injury or loss, except as may be by agents or employees of the Medical Center.

10.4. In an emergency affecting the safety or life of individuals, or of the work, or of adjoining property, the contractor, without special instruction or authorization from the Medical Center, is hereby permitted to act, at the contractor's discretion, to prevent such threatened loss or injury. Also, should the contractor, in order to prevent threatened loss or injury, be instructed or authorized to act by the Medical Center, he shall so act, without appeal. Any additional compensation or extension of time claimed by the contractor on account of any emergency work shall be determined by mutual agreement.

11. Security Requirement

11.1. Physical Security & Safety Requirements:

11.1.1. All contractor personnel must check-in with their designated VA point of contact or other identified staff prior to beginning any work.

11.1.2. The Contractor and their personnel shall follow all VA policies, standard operating procedures, applicable laws and regulations while on VA property. Violations of VA regulations and policies may result in citation and disciplinary measures for persons violating the law.

11.1.2.1. The Contractor and their personnel shall wear visible identification at all times while they are on the premises. The contractor shall sign in the VA Police services prior to beginning work each work day.

11.1.2.2. VA does not provide parking spaces at the work site; the Contractor must obtain parking at the work site if needed. It is the responsibility of the Contractor to park in the appropriate designated parking areas. VA will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.

11.1.2.3. Smoking is prohibited inside/outside any building other than the designated smoking areas.

11.1.2.4. Possession of weapons is prohibited.

11.1.2.5. The Contractor shall obtain all necessary licenses and/or permits required to perform the work, with the exception of software licenses that need to be procured from a Contractor or vendor in accordance with the requirements document. The Contractor shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract.

11.2. Access To VA Information And VA Information Systems

11.2.1. A Contractor/Subcontractor shall request logical (technical) or physical access to VA information and VA information systems for their employees, Subcontractors, and affiliates only to the extent necessary to perform the services specified in the contract, agreement, or task order.

11.2.2. All Contractors, Subcontractors, and third-party servicers and associates working with VA information are subject to the same investigative requirements as those of VA appointees or employees who have access to the same types of information. The level and process of background security investigations for Contractors must be in accordance with VA Directive and Handbook 0710, Personnel Suitability and Security Program. The Office for Operations, Security, and Preparedness is responsible for these policies and procedures.

11.3. The C&A requirements do not apply and a Security Accreditation Package is not required.

12. Confidentiality and Nondisclosure

12.1. It is agreed that:

The preliminary and final deliverables, and all associated working papers, application source code, and other material deemed relevant by VA which have been generated by the contractor in the performance of this task order, are the exclusive property of the U.S. Government and shall be submitted to the CO at the conclusion of the task order.
