DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity. Department of the Interior, Bureau of Reclamation, Interior Region 8: Lower Colorado Basin, Boulder City, Nevada.

3. Description of Supplies/Services and Estimated Cost. The Bureau of Reclamation has a requirement for On-Site Technical Support Services to upgrade the User Configurable Open System (UCOS) Field Control Units (FCUs) for the Pilot System 2 (PS2) and Pilot System 3 (PS3) used on the Yuma Desalting Plant (YDP) Distributed Control System (DCS) in support of the YDP and the Yuma Area Office’s (YAO’s) Water Quality Improvement Center (WQIC).
PS2 and PS3 are virtually identical systems in the WQIC that are used to test various pretreatment and Reverse Osmosis (RO) operating conditions and parameters. Each system consists of a Solids Contact Reactor (SCR), six Dual Media Gravity Filters, and two high recovery RO units. Additionally, the systems contain pumps, tanks, and chemical injection systems. PS2 also contains a series continuous stirred tank reactor (SCSTR) and a sludge recirculation system, which when desired can serve as a flocculation system prior to the feedwater entering the SCR. YDP operators remotely monitor and control the processes at PS2 and PS3 from the control rooms via the YDP DCS.
The existing YDP DCS is a networked industrial computer system that is used to remotely monitor and control the operation of the YDP and WQIC and its support systems. The YDP DCS is based on Control System International’s UCOS software platform. UCOS is an open architecture DCS that employs object-oriented technology to create control devices and device templates allowing the developer to configure device logic, tag definitions, and run-time graphical behavior for each device and to store this device definition in re-usable device templates. The DCS controls for PS2 and PS3 are part of the overall process monitoring and control of the YDP that can be achieved through the DCS. Each of the DCS Remote Terminal Units associated with PS2 and PS3 are configured with redundant DC power supplies, an Uninterruptible Power Supply, Modicon Quantum Programmable Logic Controllers (PLCs), and a UCOS FCU. The FCU runs a real time operating system based on a LINUX operating system which executes the pre-programmable control schemes.
Like most computer networks, the YDP DCS has to be continually upgraded to ensure relevancy with the current information technology hardware and software. While the rest of the DCS has been upgraded with newer FCUs and Input/Output (I/O) hardware, the PS2 and PS3 FCUs are older Pentium 4 computers with Modicon Quantum PLCs and I/O that were originally installed in 2006. This hardware is no longer
140R3023Q0030 Page 2 of 3 supported by the respective manufacturers and replacements are difficult to acquire commercially. This older technology prevents future upgrades to the DCS unless it is modernized with systems that are compatible with newer and more commercially available technologies.
This purchase order will focus on the replacement of the PS2 and PS3 FCUs and onsite integration, testing and commissioning of the DCS PS2 and PS3 UCOS subsystems after the older Modicon Quantum PLC hardware is replaced with newer OPTO SNAP I/O. The installation of the newer I/O and incidental equipment will be performed by the Government. The YAO currently has a service agreement with CSI that includes upgrades to the UCOS software, but the service agreement does not include on-site assistance for engineering and commissioning services to physically implement the upgrades on the YDP DCS. Because of the increased risk if the upgrade is not performed properly, YAO needs on-site assistance from CSI’s Technical Support team to perform the labor of upgrading the PS2 and PS3 FCU hardware and integrating and testing the system with the Government installed I/O.
The estimated price is $ and the period of performance is 12 months from date of award.
4. Description of Circumstances, including why only one source is reasonably available. Reclamation currently has a service agreement in place with CSI for the User Configurable Open System (UCOS) software on the YDP DCS. As confirmed by a letter from CSI on TechnipFMC letterhead, CSI holds all proprietary rights to the UCOS software and services, and CSI is the only vendor that offers software support, engineering, and sales relating to the UCOS control system including UCOS branded FCU and microFCU hardware installed at the YDP (see Sole-Source request in folder A02 of the contract file).
Software upgrades and modifications for the UCOS system are only offered by CSI as it developed the system and owns all proprietary rights. Any other company attempting to offer UCOS software upgrades or make changes to UCOS’s unique OPC interface on the Government’s system must work through CSI;
a middleman company would increase cost to the Government.
If award was made to a different vendor for alternate software, Reclamation would have to completely start over with new software and new equipment. At this time, Reclamation has invested approximately $2M into the existing platform. Reclamation would also need to retrain staff and end users on the new equipment.
IAW FAR 13.106-1(b)(1)(i), only one source will be solicited because circumstances of the contract deem only one source responsible.
5. Determination of Fair and Reasonable Price. Price fair and reasonable determination will be based on comparison of the proposed price with prices found reasonable on previous purchases, market research, and comparison to an independent Government estimate. Award will be made based on the Contracting Officer determining that the proposed rates are fair and reasonable.
6. Description of Market Research. Reclamation’s subject matter experts will continue to monitor the market for any new or up and coming technologies that could be utilized. However, market research will be conducted prior to any future acquisition, and competition will be obtained to the maximum extent possible.
