DETERMINATION AND FINDINGS (D&F) FOR SOLE SOURCE

Determinations under the Simplified Acquisition Threshold (> $3,000 but ~$150,000)

This template provides guidance for completing documentation required for justifying and approving acquisitions (greater than $3,000 but less than or equal to $150,000) of supplies and/or services through other than full and open competition. A J&A is not required under simplified acquisition procedures but rather a Contracting Officer D&F is required.

1. Identification of agency, contracting activity and location:

United States Customs and Border Protection Information and Technology Contracting Division 1300 Pennsylvania Ave NW, Washington DC 20004

2. Nature and/or description of the supplies or services being procured and the intended use. Include the anticipated cost/price. Give a breakdown of costs/prices as applicable.

Universal Brackets, designed specifically to fit US Customs and Border Protection US- Visit 10 Print Guardian L Scanner as part of a software and hardware package collecting biometric data on travelers entering the United States.

The anticipated total price for 100 brackets is $50,000.

The product description and specifications are as follows:

Product Manufacturer Product Description Qty.

3. Single source justification rationale (Check (√) one and explain the rationale selected in the spaces below—see FAR 13.106(b)(1)):

√ Only one known responsible source is available to fulfill the requirement. Explain the proposed contractor’s/vendor’s unique qualifications or the nature of acquisition that justifies the use of a single contractor/vendor – see Section 4 below.

Source: Crossmatch Technologies Inc.

3950 Rca Blvd., Suite 5001 Palm Beach Gardens, FL 33410-4227

4 Explain the rationale selected above and the extent of the market survey conducted:

The equipment outlined above was designed and developed as part of the deployed field solution for the US Visit program. The system was designed for interoperability, and the physical infrastructure and processes employed in the field are based on this specific system design. In addition, these are the only tested and CBP-approved peripherals authorized for use by the US Visit program.

Also, there were no offers from the FirstSource II contractors.

5 Determination of price reasonableness.

A statement of price reasonableness will be placed in the order/contract file. Price reasonableness will be determined by the using one or more of the pricing techniques listed in FAR 13.106-3(b)(2).
