About this file

This document is a justification for other than full and open competition to replace the generator on a representational boat for the US Embassy in Singapore. The Embassy requires a new, like-in-kind generator to replace the current inoperable system aboard the boat at an estimated cost of S$65,737.44 (US$48,694.40). EELAT Pte Ltd is identified as the sole source contractor given their specialized expertise in marine generators and certification to conduct work on pleasure craft in Singapore. Market research found no other available or qualified companies. The anticipated cost is determined to be fair and reasonable based on specialized labor requirements and scarcity of alternatives in Singapore. The justification will be published on SAM.gov and future acquisitions will aim to include competition whenever possible.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that US Embassy Singapore use other than full and open competition for acquisition of a new, like in kind generator to replace the current inoperable system aboard a representational boat. The estimated cost is S$65,737.44 (US$48,694.40).

2. Nature and/or description of the action being approved.

This request is to purchase a new generator to replace the existing generator that has malfunctioned and certified technicians have failed to troubleshoot and repair. The generator is passed the manufacturers service life and must be replaced with a unit considered “like-in-kind.” The new generator will ensure the vessel is fully operational.

3. A description of the supplies or services required to meet the agency’s needs.

The generator must be replaced to maintain the vessel in an operational status. The current generator losses power intermittently causing undue risk to the vessel crew, passengers, and other vessels operating within the waters of Singapore. Without a new generator, the vessel is not operable.

The current generator, and all associated materials and components, will be removed and replaced with a new generator that is of similar power which is referred to as a like-in-kind unit.

4. An identification of the statutory authority permitting other than full and open competition.

The statutory negotiation authority for the "sole source" procurement is 41 U.S.C.

253(c)(1) - Only one responsible source, implemented by the Federal Acquisition

Regulation (FAR) at Subpart 6.302-1.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

EELAT Pte Ltd is an Engineering Company that has been providing services for the

Marine and the Power Generation industries since 2010. They are a full-service dealer for Cummins (USA) for Marine Recreational Market in Singapore providing reliable genset for Marine and Industrial engines. They are also an accredited organization to conduct survey for pleasure craft for Singapore Registry of Ship

(SRS)/ Singapore Flag by MPA (Maritime Port Authority-Singapore). Many of their customers are Yacht/boat owners and since they specialize in genset and engines for the recreational market for pleasure craft, they are in a good position to carry out the genset replacement.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a SAM.gov notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

The Embassy did due diligence through market research and found no other available or qualified companies. A total of six (6) vendors were approached for quotations.

This JOFOC will be published on SAM.gov.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The cost to the Government will be fair and reasonable. The task requires specialized labor that is scarce and expensive in Singapore. As the necessary repair has arisen at the end of the fiscal year, there is insufficient time to run a full solicitation. However, a solicitation is unlikely to have resulted in a more competitive price due to the scarcity of options. The Embassy did due diligence through market research and found no other available or qualified companies.

The total price offered by another vendor, is S$63,114.81 (US$46,752.00). It is 30% higher than the selected vendor’s price (S$48,384.00; US$35,84000). However, the quotation was not considered as the proposed generator is larger/more powerful than the original, which would require rewiring of the boat and structural work to accommodate the extra power/size.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

Post had contacted six certified vendors to provide a quotation to replace the generator. Only one of the six vendors provided a cost estimate. The remaining five vendors refused to provide a quotation, are not qualified to work repair recreational vessels, or were not able to get a replacement generator until early CY2024. As a result, the vendor was selected based on qualifications, certifications, parts availability, and ability to provide immediate services to ensure the vessel is operational.

9. Any other facts supporting the use of other than full and open competition.

There are few certified vendors available in Singapore to conduct the generator replacement Local vendors target industrial maritime work, not recreational watercraft. After contacting multiple vendors, only one vendor was interested enough to respond and give a price estimate.

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

N/A

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

In the future and whenever possible, a proper competition will be carried out

(including quotes from multiple vendors to compare prices) before an order is awarded.
