About this file
This sole source justification memorandum requests approval to procure 10 ICP quartz force rings from PCB Piezotronics on a sole source basis under the simplified acquisition threshold. The Naval Surface Warfare Center requires these custom-designed force rings, which were developed under a previous contract, to support the Condensate TEMPALT system. No alternative commercially available force rings meet the technical requirements, and PCB Piezotronics possesses proprietary knowledge as the original equipment manufacturer. Market research confirmed PCB Piezotronics as the only source.

NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020
USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN
SIMPLIFIED ACQUISITION THRESHOLD MEMO
FROM:
CODE: 732
SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &
Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE
The Onboard Tracking & Acoustic Vibration Systems Branch, Code 732 of the Naval Surface Warfare Center requires 10 ICP Quartz Force Rings from PCB Electronics as accessories to shaker systems as a part of the CMSST TEMPALT project. Estimated cost as of .
ICP Quartz force Ring, 1k lb, 5mV/lb, integral 3ft cable to pigtail model 206M38 QTY 10

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME:
Item required must be a brand name product, or feature of a product, particular to one manufacturer.
1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).
3. Other Reasons:
NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020
B. SOLE SOURCE (select all that apply)
1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
PCB Piezotronics has completed a development effort with NSWCCD engineers on Contract #N0016717P0368 from 2017 to determine instrumentation that can work in the demanding conditions the Condensate TEMPALT system takes place in. The required instruments (ICP quartz force ring) are custom designed assemblies with specifically designed parts from PCB for the full operation of the Condensate TEMPALT system setup. Due to the uniquely tested nature of this system, a form-fit-function replacement is required. The Naval Surface Warfare Center Onboard Tracking & Acoustic Vibration Systems Branch, Code 732, has confirmed there are no alternative, commercially-available force rings that provide the needed capability to satisfy required measures.
Due to proprietary knowledge of the material, it is in the best interest of the Government to procure these 206M38 force rings from PCB Piezotronics.
Due to the success of the Condensate TEMPALT, a similar system is desired for a future CMSST TEMPALT.
This TEMPALT will require additional hardware capable of withstanding the same demanding conditions, thus requiring the purchase of additional 206M38 ICP quartz force rings.
Independent government cost estimate market research was conducted in 2 ways. (1) Historical pricing was referenced to establish benchmark pricing. Contract N0016719P0329 was awarded as a sole source
. (2) Further research was conducted to identify any new entrants into the commercial marketplace for the required materials. No new vendors were identified.
3. Other Reasons:
