(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to

FAR 13:

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. 452.237-74 Key Personnel (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: Supervisor.

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

General Information

1.0 Scope of Work

Furnish all labor, equipment and supplies necessary to provide snowplowing at the U.S. Forest Service, Penobscot Experimental Forest, 54 Government Road, Bradley, ME.

2.0 Background

The U.S. Forest Service requires that the contractor remove the snow from Government Road from the intersection with Route 178 to the Hart Bldg. by the following morning prior to 6:30 a.m. after each snow fall of 2.5” or more (or 2.5” or more of cumulative snowfalls, Monday thru Friday). Snow should be pushed back off the road as far as possible.

3.0 Technical Requirements / Tasks

• Furnish all labor, equipment and supplies necessary to provide snowplowing at the U.S. Forest Service, Penobscot Experimental Forest.

• All vendors are highly encouraged to coordinate and schedule a Site Visit / facility inspection prior to submitting their offer.

Performance Requirements:

• Snow Removal from Road:

• Snow Removal from the Parking Lot:

o The parking lot at the Hart Bldg. is to be plowed the following morning prior to 6:30 a.m.

after each snowfall of 2.5” or more (or 2.5” or more of cumulative snowfalls), Monday thru Friday. Snow should be pushed back as far as possible without damaging railings, walkways, or property.

• Snow Removal from the Oil Tank Fill:

o A walkway is to be cleared from the parking lot to the oil tank fill located on the front of the building, to the left of the ramp.

• Snow Removal and Salting from Entrance to Building:

o Snow is to be shoveled off the ramp at the same time as the parking lot is cleared. Salt is applied to ramp as needed to avoid slippery walking conditions.

• Road and Parking Lot Sanding/Salting:

o The front walkway and parking area should be salted when surface conditions warrant this, such as icing.

o Parking areas should be salted/sanded when icing exists.

o The Contractor shall use their best judgment in determining when to salt/sand, and may contact the FOS if they are unsure, or would prefer to seek approval.

o Err on the side of making conditions as safe as possible.

• The Contractor shall check with the local contact for instructions, requests, or special problem situations before leaving the area when plowing, if done during normal business hours.

• The Contractor will ask the local contact for assistance with any issues related to moving vehicles in the parking lot.

Qualifications of Contractor and Personnel

• The contractor and personnel employed by the contractor shall be capable, qualified in plowing, with prior experience plowing.

• The Contractor and employees shall be licensed as required by law.

Contractor Invoices

• Must list the date of plowing, salting, and sanding and be submitted in a timely fashion (not to exceed four weeks after date of service).

• Must break down individual charges (plowing, salting walkways, sanding parking areas, plowing for heavy storms).

Damage to Property

• In the event that the contractor damages personal property (automobiles) or government property

(including facilities), the contractor will immediately inform the FOS and local contact. Office phone number and email address for FOS are listed above.

• Any damage to Government Property incurred during the implementation of this contract must be repaired or replaced by the contractor to the satisfaction of the Government representatives.

• Contractor shall be responsible for all damage to Government property resulting from their operations.

• Damage to the building or equipment by the activities of his/her employees will fall into this category.

Safety:

• Contractor shall adhere to all applicable safety standards and should exercise caution in the performance of their duties.

• Plowing often involves long hours of driving in poor weather, and a lack of sleep can lead to unsafe operating conditions.

• Contractor should ensure that personnel working on Government property are aware of job hazards and take measures to mitigate them.

• The Forest Service adheres to the University of Maine cancellation policy. If the university is closes due to heavy snowfall or an ice storm, the Hart Bldg. will also be closed.

• Be advised that some personnel may still come to work and personnel routinely work evening and early morning hours, including on weekends.

SUPPLEMENTAL INSTRUCTIONS

• Although the performance of all work requirements is under the responsibility and management of the Contractor, the Government reserves the right to review and approve all work before their accomplishment.

• The Contractor should ask for FOS assistance with any issues related to moving vehicles to plow around them.

• The Contractor shall be licensed as required by law.

• The Contractor shall restore any damage caused by his/her operations.

DAMAGE TO CONTRACTOR’S PROPERTY

• The Government will not be responsible in any way for damage to the Contractor’s equipment kept in or near the buildings or the Contractor’s employees’ personal belongings brought onto Government premises.

4.0 Government Furnished

• The Contractor shall not use Government furnished material or equipment.

• Equipment, materials, and personnel will be the responsibility of the contractor and shall be dependent on the amount of work required.

• Trash dumpster may NOT be used by contractor to dispose of materials.

• NO SECURE STORAGE IS AVAILABLE FOR CONTRACTOR’S EQUIPMENT OR

MATERIALS.

5.0 Deliverables / Schedule

PERIOD OF PERFORMANCE: 09 January 2024 to 08 January 2025.

6.0 Travel

None.

7.0 Contractor’s Key Personnel

CONDUCT OF WORKERS
