SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C247-22-AP-0023

1. Contracting Activity: Department of Veterans Affairs, VISN 07, Charlie Norwood VA Medical Center,

(509) Augusta, GA, - NCO 7, Regional Procurement Office East, proposes to enter into a contract for Station 509. Purchase Request Number (2237) - 509-22-1-528-0001.

2. Nature and/or Description of the Action Being Processed: This procurement will result in a Firm Fix Price Contract. The procurement will be for Brand Name only for the Centrella Beds manufactured by Hillrom which can be provided by 2 known authorized SDVOSB distributors

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The estimated value of the proposed action is $402,125.00. Rehabilitation Services is replacing their current beds with 25 Hill- Rom Centrella Smart + Beds Model CNT-PAK355.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Purchase is limited to one manufacturer due to two mew technologies that provide patient sensing capabilities that no other beds contain. These technologies are WatchCare Incontinence Management System and Contact-free continuous monitoring (CFCM) powered by EarlySense which were produced internally by Hill- Rom and are proprietary technologies and Hill-Rom is the sole provider of the technologies. In addition to the CNT-PAK355 Beds the following additional options are being purchased: Patient control module containing: Nurse Call Feature, Universal TV controls and Lighting control; Accessory Outlet and ergonomic Push Handles.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Hillrom the Manufacturer has two SDVOSB authorized distributors. There are no other sources for this requirement. Authorized re-seller letters were provided by Hillrom stating Janz Corporation and DiSorb Systems Inc. are authorized SDVOSB Distributors. The Brand Name Only Justification will be posted on Fed Biz Opps.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The price is anticipated to be fair and reasonable, the estimated prices associated with this purchase are based off an established FSS Contract (VA701-17-M-0004) that will not be utilized since the contract’s vendor has designated SDVOSB’s that can provide the product. Pricing will be determined fair and reasonable by reviewing the existing contract and previously awarded contracts for similar items. In addition, these beds contain proprietary features that greatly enhance patient care that cannot be obtained from any competitors. Quotes will be requested form the two authorized SDBOB distributors.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A Vendor Fair was held that allowed numerous vendors to display and explain the features of their beds that would meet the specific needs of our organization. During the fair hospital staff from the units that will be using the beds were allowed to interact with the vendors asking questions and obtaining hands on experience with the different beds being displayed. The staff then provided reviews of the products displayed which narrowed the selection down to the Hill-Rom Model that has proprietary features eliminating other manufacturers from further consideration. Further research revealed Hill-Rom whish is a large business does utilize authorized distributors to further market their products. Two of the authorized vendors, Janz Corporation and DiSorb Systems Inc. are Certified SDVOSB’s vendors that can meet the government’s needs. Both vendors are verified in VIP. NRM Class waiver exists for NAICS Code 339113 Furniture, Hospital, Specialized (E.G,. Hospital Beds, Operating Room Furniture), Manufacturing.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: The proprietary nature of the requirement limits competition to only vendors that can provide the Centrella Beds.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There is no planned subsequent acquisition for this requirement at this time. Subsiquint actions will be independent of this action.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
