Limited-Sources Justification (LSJ) For orders or BPAs exceeding the Simplified Acquisition Threshold

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity. Identification of the agency, contracting activity, and specific identification of the document as a “Limited-Sources Justification.”
The Department of Homeland Security (DHS), Cybersecurity and Infrastructure Security Agency (CISA) Chief of the Contracting Office (COCO) proposes to award a task order under the General Services Administration’s (GSA) Multiple Award Schedule (MAS) pursuant to FAR 8.405-6(a), Limiting Sources.
2. Nature and/or description of the action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).
DHS/CISA COCO intends to limit the number of sources solicited pursuant to FAR 8.405-6(a) for a nine (9) month bridge task order in order to continue Administration and Program Management Support Services while a competitive effort is underway to the following contractor:
RCM Solutions, 4801 Tesla Drive, Suite C, Bowie, MD 20715.
3. Description of Supplies/Services. Describe the supplies or services to be acquired. Provide the estimated total value (including options, if any).
In support of its mission, DHS CISA Infrastructure Security Division (ISD) Office of Bombing Prevention (OBP) requires contractor support to continue Administration and Program Management Support in order to effectively coordinate, synchronize, integrate and operate. An integral role to this requirement is the integration / support functions that will be provided for the OBP Front Office. This requirement also provides Executive Assistance support to ISD’s Front Office. Current support ends on August 11, 2023, and a break in service would result in a severe mission execution impact to ISD OBP.
The total estimated value of the firm fixed price task order is for a period of performance of nine (9) months, August 12, 2023 – May 11, 2024.
4. Authority and supporting rationale.
8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
This acquisition is being conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies, in accordance with FAR 8.405-6(a), Limiting Sources. An award will be made to RCM Solutions, GSA MAS contract number GS-35F-593GA, in the interest of economy and efficiency as a logical follow-on to an original Federal Supply Schedule order #70RCSA19FC0000005 pursuant to FAR 8.405- 6(a)(1)(i)(C). The original award was competitively solicited and awarded under CISA Multiple Award BPA 70RNPP18A00000005 using the ordering procedures at FAR 8.405.

OBP Administration and Program Management Support is currently provided via Blanket Purchase Agreement (BPA) Order 70RCSA19FC0000005 which was competitively awarded against CISA Multiple Award BPA 70RNPP18A00000005 with Deloitte Consulting LLP (Large Business). RCM Solutions (Small Business) was the quoted subcontractor on the original BPA Order, and remains the subcontractor responsible for providing the majority of the current contract support.
A competitive follow-on to BPA Order 70RCSA19FC0000005 has been actively underway since March 2023, and based upon that action’s milestone plan, CISA sought to extend the BPA Order’s end date from 5/11/23 to 11/11/23 pursuant to FAR 52.217-8 Option to Extend Services. This extension would support both the completion of the competitive action and allow for an orderly transition between the outgoing and incoming Contractors. However, the BPA Order was instead extended for continuity for 90 days (8/11/23) pursuant to FAR 52.237-3, and FAR 52.217-8 Option to Extend Services is no longer available to extend the contract. This extension allowed time to continue efforts; however, it necessitates a short-term bridge. The underlying ordering period for the CISA Multiple Award BPA has ended, and no additional BPA Orders may be awarded or competed against that vehicle. There are no further options or extensions available on the BPA Order; therefore, the bridge is required utilizing the incumbent’s underlying GSA Schedule contract.
The proposed bridge task order is necessary for continued administration and program management support services while CISA COCO and ISD/OBP defines, solicits, negotiates, and awards a competitive task order. At this time, RCM Solutions is the only incumbent vendor capable of continuing the OBP support services during a short-term bridge task order. The contractor’s employees have already been cleared and seeking an order issued to another contractor for the interim period of nine (9) months could cause severe delays (i.e., inefficiency while new contractor employees are cleared) and impede OBP’s ability to accomplish its mission; especially since the onboarding process at CISA for new personnel can take up to nine (9) months which is the duration of the bridge, thus defeating the purpose. The competitive follow-on effort estimates a solicitation release in September/October 2023, with an award in December 2023/January 2024 to allow adequate time for transition between RCM Solutions and the successful offeror.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing the proposed Task Order to RCM Solutions for a short-term bridge of administration and program management support services represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” GSA has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, prior to issuance of the task order, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific task being ordered in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate (IGCE).
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market research was conducted to determine if a DHS strategic sourcing vehicle (SSV) was available to support this short-term bridge. Based on the scope and duration of this requirement, the SSVs did not
