DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C258-20-AP-1260

1. Contracting Activity: Department of Veterans Affairs, NCO 22 Gilbert. The Northern Arizona VA

Health Care System has a request for twenty (20) Zoll R Series Plus Defibrillators. The 2237 number for this request is .

2. Nature and/or Description of the Action Being Processed: BRAND NAME only. This acquisition is for the purchase of twenty (20) R Series Plus Zoll defibrillators for use on the medical center’s crash carts.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

This acquisition is for the purchase of twenty (20) R Series Plus Zoll defibrillators for use on the medical center’s crash carts located at the Northern Arizona VA Health Care System in Prescott, Arizona. Only Zoll can meet the minimum requirements listed below. Competitor products do not have CPR feedback built into their units for both adult and pediatric Veteran patients, they do not have see-through CPR, and are not Federal Information Processing Standard Compliance (FIPS) compliant for the VA wireless network.

This new technology is required because it will; 1) reduce operator errors in high stress code situations due to the ALS/BLS mode-ease, 2) the new technology which includes wi-fi, current machine status, to include post event data that is required for operational/clinical readiness necessary to take care of Veteran patients.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The capability to improve any operational and clinical measures at a hospital are key contributors to survivability in code events. The ZOLL Defibrillator Technology has published data that supports improved outcomes from Cardiac Arrest. Using Real Time CPR Feedback for both Depth, Rate, and Release of compressions, along with a see-through CPR technology that allows for the clinician to view an underlying heart rhythm during compressions, these advanced technologies allow the VA hospital staff to meet the American Heart Association Guidelines for limiting pause times to less than 10 seconds. ZOLL Defibrillators are the only devices that also offer Federal Information Processing Standard Compliance (FIPS) and can be connected to the VA Wi-Fi Network to allow for automatic wireless transmission of code data Debriefing and Charting. Defibrillator Dashboard Software helps ensure safety by wirelessly transmitting the daily check information to a server that will automatically transmit notifications to the hospital staff if there is something wrong with the device or pads. Extensive market research has been performed by the Northern Arizona medical staff based on required equipment characteristics, including performance specifications, oxygen use parameters, power requirements, size; The Zoll R Series that can be provided by the proposed vendor After Action Medical and Dental Supply are the only known defibrillators that provide the full range of functionality required. Similar competitor products do not have the necessary CPR feedback built into their units for both adult and pediatric patients, do not have see-through CPR, and are not FIPS compliant, allowing for connectivity to the Northern Arizona hospitals wireless network.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

An Sources Sought Notice was posted to both GSA and Beta.Sam to determine if there were any SDVOSB/VOSB authorized distributors of Zoll equipment. Two SDVOSB’s responded to the notice with documentation confirming that they were authorized distributors. As such, this requipment can meet the rule of two, and will be set-aside for SDVOSB’s via an open market solicitation.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

As the SDVOSB's that responded are authorized vendors, their prices must adhere to current market prices.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

There is an SBA Class waiver for NACIS 334510, and the waiver list is included in the briefcase. While this procurement does not require being set-aside for small business under 13 CFR § 121.406, the VA Rule of Two can be met. Based on the market research conducted, recommend that the procurement should be set-aside for SDVOSB’s via an open market solicitation.

Competition before Making subsequent acquisitions for the supplies or services required:

At the present time we are following leads and awarding contracts when we find acceptable stock that is available for a quick delivery making these awards based on urgency as COVID is still a concern for Veteran and civilian populace care. The VA will continue to request offers from as many potential sources as is practicable under the circumstances and as the market conditions change and become more stable VA will comply with full and open competition.
