Simplified Procedures for Certain Commercial Items
Exceeding the Simplified Acquisition Threshold (SAT)
FAR Subpart 13.5, including Brand Name

Pursuant to the requirements under the authority of simplified procedures for commercial items at 41 U.S.C. 1901 as implemented by Federal Acquisition Regulation (FAR) Subpart 13.501 and consistent with the content requirements of FAR 6.303-2.
1. Agency and Contracting Activity.
The Department of Homeland Security, U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), plans to enter into a contract on behalf of the Office of Asset and Facility Management (OAFM) for parking spaces on a sole source basis. This document sets forth the justification and approval as required by FAR 13.501(a).
2. Nature and/or description of the action being approved.
(a) Type of action: Firm Fixed Price Purchase Order
(b) Amount the current J&A is justifying: $129,800.00
(c) Brief Description: OAQ intends to procure, on a sole source basis, 40 unreserved secure parking spaces at the Tech World Building, located at 801 I St, NW, Washington DC
20007. This action is being taken pursuant to the authority of FAR 13.501.

3. Description of Supplies/Services. Describe the supplies or services to be acquired.
Provide the estimated total value (including options, if any).
This requirement is to provide 40 unreserved secure parking spaces at the Tech World
Building, located at 801 I St, NW, Washington DC 20007at an estimated total cost of
$141,600.00. This requirement is based on ICE location, and mission specific to ICE operation, and is necessary for providing security to employees.

4. Identification of the authority.
This action is being taken under the authority of Simplified Procedures for Commercial
Items, 41 U.S.C. 1901 Simplified Acquisition Procedures as implemented by FAR 13.501.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
a. The contractor has fulfilled the requirement on a sole source basis since August 2014.
Coordination was made with the General Services Administration, as they manage the Government Class A Space to include parking.
b. ICE is waiting for DHS/CSRO approval for long term, 5-year period of performance. This award will be utilized until a decision is made.
c. The proposed parking location is based on ICE location, and mission specific to the operations and is necessary for providing security to employees. Therefore, it is deemed critical that senior and operation mangers have reliable and immediate accessibility to parking on a 24/7 basis daily to support the agency’s mission.
d. Pursuant to 41 U.S.C. 1901 Simplified Acquisition Procedures as implemented by
FAR 13.501(a) and 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
e. Due to the unpredictable work schedules and the likelihood of overtime required due to operational needs, it is impractical for Senior and Operational
Leaders to depend on Mass Transit or parking locations outside the assigned duty location.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

The discussion should include whether a FedBizOpps notice was or will be publicized, as required by FAR Subpart 5.301, 6.305(a). If the justification covers a brand name item, this section should address compliance with FAR 5.102(a)(6)).
☒ OAQ intends to make this justification publicly available pursuant to FAR 6.305 on
FedBizOpps on approximately 30 March 2020.
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Use information such as commercial pricelists or prior acquisition history that will help the
Contracting Officer determine the anticipated cost is fair and reasonable or you may discuss the application of any of the techniques described at FAR 15.404-1.
The contracting officer determines that the anticipated price will be fair and reasonable based on a comparison to the current pricing. Reference Purchase Order HSCEMR-14-P-00016 modification P00008. The current pricing is $295.00 per parking spot per month, the same as the pricing currently offered.
8. Description of market research.
The OAM Program Analyst conducted a market research of current parking space rates available throughout several locations in the DC area. The average rate for the garages within a two-block radius of the Tech World is $300.00 per month.
The parking estimates were based on normal parking garage operations, including contractors provided parking attendants and DC parking tax. The market research also indicates that the following factors shall be considered during negotiations:
• Subject garage (801 I St., NW), currently operating as a public garage, is charging a monthly rate of $295 to the general public for non-reserve parking.
• Parking garage at 909 7th Street, NW, with similar operations as subject parking garage is currently charging a monthly rate of $300 to the general public.
• Parking garage at 799 9th Street, NW, with similar operations as subject parking garage is currently charging a monthly rate of $310 to the general public.
• Parking garage at 901 K Street, NW with similar operations as subject parking garage is currently charging a monthly rate of $295 to the general public.
While there are other parking options in the area, due to the circumstances outlined in paragraph 5 above only one source can fulfill the agency’s need.

9. Any other facts supporting the justification.
Not applicable.
10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.
No other sources have expressed interest in this acquisition.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.
Due to the unique nature of this requirement, no future to permit competition are known to the Government.
12. DHS intends to post the requirement pursuant to FAR 13.501(a)(1)(iii) and 6.305(a) or for brand name FAR 13.501(a)(1)(iv) and 5.102(a)(6).
OAQ intends to make this justification publicly available pursuant to FAR 6.305 on
FedBizOpps on 03 April 2020
