SOLE SOURCE JUSTIFICATION

(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $150K

1. Agency/Contracting Activity: Mission Installation Contracting Command- Ft Knox

2. Description of Action:

Nature: New Requirement Follow-On Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time and Materials

Funds: OMA Other Funds:__JCLC_______

3. Description of Supplies/Services:

a. The total estimated dollar value of the proposed action is $80,287.13

b. Florida site, facilities, meals, support and training venues to conduct the Lee County

JROTC FGCU STEM JCLC 2019.

4. Authority:

Action using Simplified Acquisition Procedures

FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.

urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reason for Authority Cited: Cadets and instructors require a safe installation at a local University with dormitory availability and qualified screened staff to provide STEM training. In addition, there is no other suitable site available during the authorized dates set by The School District of Lee County (4-7 June 2019). Florida law requires all summer camp personnel of K- 12 students to have a level 2 background screening complete. Sole Source Justification to provide meals in the execution of JROTC STEM for 120 cadets and 15 adult leaders from 21 various 6th Brigade JROTC programs that are scheduled to attend STEM JCLC, located in Ft Myers Florida, during the period 4-7 June 2019. JCLC is a mandated annual training requirement depicted in Army Regulations and Cadet Command Regulation 145-2. Coordination and research of locations to conduct JCLC in Florida began early in June 2016. Presently only two Universities, FAU and FGCU offer STEM in Florida. FAU is over 150 miles away in Palm Beach, FL. This is the most economical and effective option to train and feed this number of cadets. Our research indicates expenditures exceeding $70K would be the norm. The transportation costs to travel to Palm Beach would add an additional $6000 to the cost. Florida Southwest University does not possess the dormitory availability for 135 cadets and aduilts during that time.

7. Market Research:

Coordination and research of locations to conduct JCLC STEM in Florida began early in June.

Presently there are no closer University Facilities to provide dormitory and qualified screened training staff. This is the most economical and effective option to train and feed this number of cadets. Our research indicates expenditures exceeding $60K would be the norm. The only suitable window is FGCU, 4-7 June 2019.

9. Additional information to support the justification: Florida Law requires all summer camps for K-12 to have all staff members pass a level 2 background screening for child safety.

Any organization contacted must have the ability to have their staff background screened for summer camp. This includes all volunteers or students and faculty who have more than 8 hours of student contact. Florida law states that summer camp background screening must go through the Florida Clearing house and cannot begin until February of that year. The background screening also costs $75 a person.

Florida Southwest University, the only other University in Ft Myers with dorms, does not have the dorm facilities to house 135 cadre and cadets during that time frame.

Florida Gulf Coast University is the only approved facility in Ft Myers, Florida suitable to conduct a STEM JCLC during the available dates (4-7 June 2019) allowed by our school district.

FGCU provides as close as possible all the required elements and available facilities large enough to billet cadets and the capability of conducting the mandatory training onsite and meet the regulatory intent. The University also complies with the Florida law for background screening of summer camp personnel. If this was not to occur an alternate location will have to be negotiated, making request for transportation cost unreasonable. The nearest other Universities who might be willing to support our request are more than 150 miles away. FGCU provides its own dining facility operations and they are only allowed to operate on the campus.

Meals include: 3 breakfast meals, 4 lunch meals, 3 dinner meals and water to prevent heat injuries.
