(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall
P15PS00840 Page 8 of 30 be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

1452.201-70 AUTHORITIES AND DELEGATIONS (SEPT 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

(a) The contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such fraud, waste, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(b) The contractor shall notify employees that the prohibition and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect.
(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

Specifications
Rental Dump Trucks, 12+ cubic yard, Peterbilt 367 (tandem axle) or Equal
GENERAL
Rental of Two (2) or Four (4) dump trucks is required for various projects within Denali National Park and Preserve. Rental will be for a period of approximately 4 months each (May 26, 2015 through September 16, 2015). The trucks will be used park wide and at times adjacent to wetlands and free water and must be in excellent mechanical condition. The trucks will also be expected to make trips into Fairbanks or other local municipal areas.
• Rental cost shall include delivery and pickup costs to and from Denali National Park Auto Shop.
• Trucks shall be 2008 model year or newer, shall be able to pass State of Alaska DOT inspection, be
• mechanically sound and trouble free.
• Trucks shall be free of oil, fuel, coolant and other fluid leaks and signs of such leaks.
• Trucks shall be clean of any mud, organic materials or any other seed bearing type soils
• Hydraulic hoses shall be in excellent condition with fluid carrying components having no leaks or signs of leaks.
• All tires including all spares shall be in good to excellent condition, with tread wear of no less than 13/32 tire thread depth.
• One spare tire mounted on rims for drive wheels shall be supplied for each truck.
• Trucks shall come with one spare set of service filters and a fresh engine service with no major services (1000, 2000 hour, etc) required during the rental period.
• If equipment breaks down or otherwise becomes inoperative and is not restored to operating condition within 48 hours, the contractor will be notified by NPS Procurement to furnish like replacement equipment meeting specifications within five days.
Equipment Specific Specifications Trucks shall meet or exceed these specs:
• Peterbilt 367 (tandem axle) or equal, 2008 model year or newer.
• Cummins ISX @ 485HP engine with 1800 ft lb torque or equivalent.
• Front axle load no less than 14,500 lbs.
• Rear axle load no less than 46,000 lbs., locking
• Manual transmission: no less than 18-speeds.
• Must have an engine compression retarder.
• Tires shall have a medium gravel lug, 14 ply or equal.
• Fuel Tanks: 120-gallon minimum.
• Air brakes with industry standard trailer towing package.
• Must have High-lift hydraulic tail gates for passage of large objects such as stumps and rocks as well as precision spreading of fine materials and rock.
• Plumbed for air, electrical and hydraulics with air pintle hitch for pulling 25 ton triple axle equipment trailers.
• Pintle will be 24-40” from road surface or adjustable pintle is acceptable.
• Must have attached load cover mechanism for covering loads hauled on state highways.
Maintenance
Routine and preventative maintenance will be performed by the government using cycles and methods accepted by the manufacturer. Repair of major breakdowns is the responsibility of the contractor. Contractor is required to contact Denali National within 12 hours after notification of major breakdown.

Location and use of trucks The trucks required are for use by the National Park Service staff at Denali National Park. They will be used to haul excavated and processed materials for road repairs and projects. Equipment will be used and operated by National Park Service employees, who are properly trained, experienced and licensed.
Pickup and delivery Delivery of the equipment shall be no later than May 26, 2015, between the hours of 7:00AM and 5:30 PM and the release date for the equipment will be approximately September 16th, 2015. Point of delivery and release will be at the National Park Service Auto Shop yard at C-Camp in Denali National Park. There is a loading dock at the delivery/pickup point.
CONTRACT TIME
The contract period will begin on the date the equipment is accepted for use by the Government at the point of hire. The contract period shall terminate when the equipment is released by the government at the point of release.
INSPECTION
The Park Service may send an operator or mechanic or both to inspect equipment before acceptance or delivery to verify excavator condition.
All delivered trucks and delivery trailers shall be cleaned and free of mud, weed seeds and any other organic materials prior to arrival in the park. Equipment shall be inspected upon arrival and will be rejected if not clean of these materials
