DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C241-24-AP-0787

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 1, located at

Bedford MA, in support of VISN 01, VA Health Care System at Manchester NH Medical Center 2237 # 608-24-1-7441-0023

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

MRI Storage.

Project management, labor, equipment, transportation, rigging and materials to provide up to 3 months of off-site temporary storage connected to a fully operational cryogen farm, delivery, and installation of the Siemens 1.5T MRI magnet to the Manchester VAMC. The magnet must always be maintained and operational according to Siemens-specified conditions to ensure this Siemens 1.5T MRI magnet is not damaged in any way and is fully operational when reinstalled.

The estimated value of the proposed action is $34,950.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The Manchester Healthcare System ordered the MRI through NAC on Delivery Order 36A79723F0016 under DLA Contract SPE2D1-17-D-0023. Manchester cannot receive the MRI due to a delay in the construction project that is taking place in the area where the MRI will be installed.

The VAMC tried to modify the delivery order but the NAC denied their request. This contract action is a follow on to the delivery order to pay for the storage of the magnet for 90 days until the construction is complete.

The contract action is planned to be open market. MRI storage is not included in the DLA Contract

SPE2D1-17-D-0023.

Via email, Siemens representatives said they cannot represent that they are the sole source provider of this service. They did not provide a sole source letter. However, due to the peculiar nature of this requirement, no other sources can perform the work without the VA incurring risk and cost not expected to be recovered through competition.

4. Description of market research conducted and results or statement why it was not conducted:

SBA Vet Cert searches did not reveal any potentially capable SD/VOSB that can provide the product.

DSBS searches did not reveal small businesses able to provide this requirement.

FPDS search revealed several moves, storage, and reinstall of MRI Magnets. Each contract was awarded to the respective MRI OEM. The service is not available in GSA Advantage or any other Government-wide contract.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
