1. Contracting Activity: Department of Veterans Affairs, VISN 9, Lexington VA Health Care System
NCO 9, Services 596-23-1-077-0017
2. Nature and/or Description of the Action Being Processed: The Lexington VA Health Care System requires software management service agreement on the BD Alaris infusion pump server and corresponding software. Software releases, upgrades, technical support, and remote support to be included.
Estimated cost: Base Year: 10/1/2022-9/30/2023 $41,790.00
Option Year 1: 10/1/2023-9/30/2024 $41,790.00
Option Year 2: 10/1/2024-9/30/2025 $41,790.00 Option Year 3: 10/1/2025-9/30/2026 $41,790.00 Option Year 4: 10/1/2026-9/30/2027 $41,790.00 Total $208,950.00
3. Description of Supplies/Services Required to Meet the Agency’s Needs: This procurement is for
Alari infusion pump system at the Lexington VAMC, in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-1.
4. Statutory Authority Permitting Other than Full and Open Competition: .
( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;
( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 ( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5;
( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Carefusion Solutions LLC is the exclusive authorized service provider for Alari infusion pump system equipment parts and the service provider for installation, warranty and post-warranty. Carefusion Solutions LLC service with OEM quality and the value of an independent service organization.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
CareFusion Solutions, LLC is the exclusive manufacturer of Alaris® products and software. A propriatry letter was added to the briefcase
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Consideration of pricing was conducted using other comparable similar contracts awarded by other agencys to Alpha sources inc. (FAR 6.303-2(b)(7)).
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: VIP database, GSA and eLibrary were searched with 11 results for SDVOSB/VOSBs. Dut to emergent in nature of the procurement a solisitation was not issued because of the direct impact to patient care at the Lexington VAMC. Carefusion Solutions LLC is the OEM for the Alaris system. A propriatry letter was added to the briefcase. This procurement will be awarded to a large business on open market.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Without the support agreement from Carefusion, if there are any issues with the server or software, Pharmacy may have to manually input drug updates on all the infusion pumps, which opens us up to human error and ultimately patient safety issues.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
CareFusion Solutions, LLC is the exclusive manufacturer of Alaris® products and software including Guardrails® Point-of-Care Software, Alaris® Pump Module, Alaris® Syringe Module, Alaris® PCA Module and Next Generation Alaris® PC Unit.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
