DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C261-23-AP-2716

1. Contracting Activity: Department of Veterans Affairs, NCO 21 on behalf of VISN 21, VA San

Francisco Medical Center at 4150 Clement Street, San Francisco, CA 94121

PR: 662-23-2-096-0199

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Sterrad 100NX sterilizer /

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The STERRAD 100NX Sterilizer is designed for sterilization of both metal and nonmetal medical devices at low temperatures. The STERRAD Sterilization Process is a multiphase sterilization process that utilizes a combination of exposure to hydrogen peroxide vapor and plasma to safely sterilize medical instruments and materials without leaving toxic residue. Because the cycle operates within a dry environment and at low temperatures, it is especially suitable for instruments sensitive to heat (less than 250 degrees F/ 120 degrees C) and/ or moisture.

This sterilizer is manufactured by Advanced Sterilization Products Inc, and there are several pieces of equipment on site that are speced to ASP equipment, causing compatibility issues if another brand of sterilizer was used. “Consumables” or chemical indicators & sterilant would increase in cost if another manufacturer were chosen. Additionally, another Sterrad 100NX was purchased last year and is on site, and it would be necessary to standardize the equipment on site in order to prevent unnecessary training on how to use other devices.

ASP has no small business distributors, necessitating the need for a sole source.

4. Description of market research conducted and results or statement why it was not conducted:

SAM.Gov was reviewed, a recent notice of intent to sole source (to award to Advanced Sterilization Products (OEM)) was published under 36C24723Q0673 on 05/12/2023 for a Sterrad 100NX sterilizer.

FPDS was reviewed, where contract 36C25922P0793 was awarded to Advanced Sterilization Products for a Sterrad 100NX on 08/15/2022 in the amount of . This action was not competed.

Vetbiz was reviewed, no significant results were found.

A sources sought was published on Contract Opportunities under the ID 36C26123Q0565 between the dates 04/10/2023- 04/17/2023. No responses were received. The Sources Sought issued on 04/10/2023 through contract opportunities on SAM.Gov did not received any responses.

GSA Advantage was reviewed, and though some ancillary supporting equipment of the Sterrad 100NX was found, the sterilizer itself was not available.

GSA eLibrary was reviewed, schedule 65 II A | A-89 has 47 total contractors, including Advanced Sterilization Products. None of these vendors responded to the sources sought.

The NAC was reviewed, where contract 36F79719D0090 was found, ASP’s (OEM) FSS contract. The needed sterilizer was not present on this contract.

SEWP was reviewed, with no significant results.

The Supply Chain Master Catalogue, offered no significant results.

36C26122P1426 was reviewed, recently awarded for the same Sterrad sterilizer for VASFHCS. The JOFOC and MRR were also reviewed. This action was also sole sourced to the OEM ASP.

Recommend a sole source to Advanced Sterilization Products Services Inc per FAR 13.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
