Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C241-24-AP-2708

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 1, located at Bedford MA, in support of VISN 01, VA Health Care System at Boston Medical Center 2237 # 523-24- 3-7441-0026.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

LT Pulse 120 EssentialCare

The estimated value of the proposed action is $104,500.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Lumenis Pulse 120H Holmium Laser System with MOSES Technology is a groundbreaking, patent-protected pulse delivery technology that remarkably improves energy transmission, resulting in more efficient lithotripsy treatments than regular holmium pulse. For benign prostatic hyperplasia (BPH) treatments, MOSES Technology results in significantly shorter treatment time due to improved enucleation efficiency and hemostasis compared to regular holmium pulse.

ExpertCare service plans can help preserve equipment uptime with access to hassle-free priority care and predictable cost of ownership.

4. Description of market research conducted and results or statement why it was not conducted:

Market Research did not reveal any capable SD/VOSB that can provide this requirement. VFCP cannot be applied because the VA Rule of Two cannot be met.

According to Boston Scientific, they are the sole authorized service provider for Boston Scientific’s Holmium and CO2 Laser families in the United States. They have access to manufacturer-supported training and spare parts, all integrated in the Boston Scientific Quality System. No other concern can perform maintenance on this equipment at the level required by the VA. A response from a large business was received to the intent to sole source posting. However, they do not represent best value to the VA.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
