About this file

This document summarizes a justification for a sole source award and a related federal contract opportunity notice. The Department of Veterans Affairs Portland VA Medical Center intends to award a sole source, firm fixed price contract to Olympus America, Inc. for a three-month bridge lease of GI endoscopy equipment including video gastroscopes, colonoscopes, fiber scopes, and associated processors and light sources. The justification cites the proprietary connections of the incumbent equipment as limiting availability to only Olympus. The notice states the objective is to initiate a new four-year lease and that responses to the notice will be considered until January 31, 2024, with submissions directed to the specified contracting officer via email.

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C260-24-AP-1545 JOFOC Tracker: FY24-NCO20-806

1. Contracting Activity: Department of Veterans Affairs, Veterans Healthcare Administration, Regional Procurement Office West, Network Contracting Office 20 on behalf of VISN 20, Portland VA Medical Center. 2237 #: 663-24-2-9961-0098.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a sole source procurement for Olympus lease of GI endoscopy equipment leased by the Portland VA Medical Center. The GI endoscopy equipment to be provided are video endoscopes, video processors, etc. Additional procurement time is needed to put in place a new 4-year lease with modernized scope equipment. Therefore, this 3- month bridge will allow the procurement time needed to complete the new procurement request.

Estimated Ammount:

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This is a 3 month bridge to continue the current lease of Olympus GI endoscopy equipment currently in service at the Portland VAHCS. The scope equipment includes proprietary connections to medical equipment which will not allow the use of other manufacturer equipment. Portland VAHCS is in the process of upgrading the fleet of GI endoscopy scopes which share this proprietary connectivity. This 3-month bridge must be awarded to ensure the Olympus scopes remain available for direct patient care by 5/1/2024. This requirement is to provide a 3-month bridge to the existing lease V797P-2065D 36C26019F0420 that expires on 1/31/2024. The station conducted market research which concluded that the existing integrated medical equipment (Olympus Visera Elite video processors (OTV-S190) and light sources (CLV-S190) do not allow for other than OEM equipment to be utilized. Market research indicates there are no contractors available to provide leased equipment other than Olympus Americas, Inc. Therefore, It is determined that Olympus Americas, Inc. is the only source for this 3-month bridge of the current lease.

4. Description of market research conducted and results or statement why it was not conducted:

Pursuant to FAR Part 10 and VAAR 810.001-70 Market Research was conducted by both station subject matter experts and NCO 20 Contracting.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
