Justification for Single Source Awards IAW FAR 13.106 1 For
Over Micro Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C241 23 AP 3336
1. Contracting Activity: Network Contracting Office 1, Regional Procurement Office East, on behalf of the Department of Veterans Affairs, VISN 1, Jamacia Plain VA Medical Center, 150 S. Huntington Avenue, Jamaica Plain, MA 02130 4817.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a new, brand name requirement. The Contracting Activity is seeking to obtain delivery and installation for (1) MAIA Micro Perimeter manufactured by OEM LB iCare USA, Inc., 4700 Falls of Neuse Rd., Ste.
245, Raleigh, NC 27609 (UEI: E2AGKEJGJYP5) solely distributed by SDVOSB Melling LLC, 658 South Columbus Street, Alexandria, VA 22314 (UEI: CA7CDKQND7U9). Jamacia Plain VA Medical Center’s Optometry Department is seeking the iCare MAIA. The MAIA is a microperimeter that combined visual field tests, fixation loss correction with real time retinal tracking and SLO imaging in one exam. Estimated Amount

Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This device measures blind spots in patient’s vision so Optometry can prescribe devices like prism to direct vision away from the blind spots. This device is very important for patients with macular degeneration. Boston’s VA Healthcare System has used this before as a demo and there are several doctors who use this daily within the Jamacia Plain facility. Due to continued use and need of this equipment, Optometry needs this in place for patient care. This is a well known product used nationwide and throughout VA Boston. Jamacia Plain’s Optometry staff is familiar with the vendor and their products making it an easier transition to the upgraded system.
4. Description of market research conducted and results or statement why it was not conducted:
The Contracting Activity conducted its first search on VetCert using NAICS 339112 which borne rather broad results, 604 to be precise. SBA DSBS search using NAICS 339112 along with keyword “iCare” generated 6 profiles matching those criteria, however none are authorized to provide this optometry equipment. GSA search using keyword “iCare” yielded 1 small business, ICARE SOLUTIONS LLC, however this is not the OEM iCare USA Inc. FPDS search using product name “MAIA Micro Perimeter” which produced 0 contract actions. Last search was on VetBiz using NAICS 339112 along with keyword “iCare” returned 2 organization, Bravo, Inc and Americare LLC who both are not authorized to provide. OEM LB iCare states this equipment is only the authorized distributor of the MAIA into the Federal Government. Since this requirement is above $25,000 an Intent to sole source notice 36C24123Q0856 was published on Contract Opportunities 07/11/2023 with a closing date of 07/14/2023 with the intention of sole sourcing this procurement to SDVOSB Melling, LLC, however based on their quote submitted, their pricing was determined to be unfair and unreasonable being 18.88% higher than the IGCE which was based on the manufactures catalog price for the same equipment. The OEM does sell direct; however they prefer to go through their SDVOSB, unfortunately in this situation we will end up having to purchase this equipment directly from the OEM. The rule of two was not met.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106 1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
