Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C246-24-AP-2910

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office, VISN

06, on behalf of the Durham VA Medical Center, 508 Fulton Street, Durham, NC 27705- 3875 (558) Oncology Department in Durham, North Carolina, requires continuous preventative maintenance on Varian radiation therapy, equipment, and software for the Varian Aria/Eclipse radiation therapy equipment. The purchase request number is 565-23-1- 090-0082.

2. Brief Description of Supplies/ Services required and the intended use/Estimated

Amount: The Durham Radiation Oncology Services currently utilizes the Varian Aria/Eclipse software solution for its oncology patients. The required service for continuous preventative maintenance on Varian departmental, administrative, and clinical activities. It also provides for scheduling clinical activities and activities for billing purposes.

The estimated value of the proposed action is $ 218,333.33

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Radiation Oncology software manages departmental, administrative, and clinical activities. It also provides for scheduling clinical activities and activities for billing purposes. The Eclipse Treatment Planning System is used to plan radiotherapy treatments for patients with malignant or benign diseases. The Eclipse TPS is highly specialized software used by medical professionals trained in radiation dosimetry for patients considered suitable for radiotherapy by an oncologist. Eclipse is used to plan external beam irradiation with photon electron and proton beams and for internal irradiation treatments. Software support for Varian Software is already in use at the Durham VAMC. The software that is being covered by this contract is ARIA Radiation Oncology and TPS Eclipse Essentials Services, and it will include software updates, help desk support, maintenance, and training. As the OEM of the equipment, Varian Medical Systems, Inc.

provides the unique capability to service its equipment and provide proprietary updates and support. No other vendor can provide maintenance and support for this equipment, and going with any other vendor would cause unacceptable delays and would be a substantial duplication of cost.

4. Description of market research conducted and results or statement why it was not conducted: Market Research revealed no SDVOSB or VOSBs were found using the NAICS 513210 and keywords VARIAN HOSTING through the SBA VetCert and VIP query.

Based on the market research, no two (2) or more SDVOSB vendors can provide the Varian Aria/Eclipse Full-Scale Service Maintenance. As the OEM, Varian does not sanction non- Varian training centers to provide technical maintenance training for Varian products. The VA Rule of Two cannot be met.
