Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity: Department of Veterans Affairs, VISN 09, TVHS VA Medical Center, 626-23-3- 2171-0070

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The TVHS VA medical centers have a requirement to provided preventative maintenance and repair to their Medtronic Ventilator System. The total estimated value is $176,478.50.

Ordering period 1: 06/17/2023 – 06/16/2024 = $88,239.25 Ordering period 2: 06/17/2024 – 06/16/2025 = $88,239.25

Total: $176,478.50

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Ventilator Machinery is a proprietary product to Medtronic. These instruments are to be serviced by an authorized Medtronic factory-trained service engineer utilizing original equipment manufacturer (OEM) direct replacement parts to ensure safe and predictable performance. Medtronic has provided a proprietary letter contained in the briefcase.

4. Description of market research conducted and results or statement why it was not conducted: A SBA Search was conducted using NAICS 334510 and Keyword Ventilator- 1 Vendor was returned on this search. However, due to the proprietary nature of this requirement, Medtronic is the only vendor that is able to provide this service.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
