1. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The purpose of this request is to obtain the enhanced entry screening services for VA Office of Community Care in Denver, CO. Moreover, this requires a contractor to administer temperature screening as well as conduct medical screening questions to help identify individuals who are exhibiting signs, symptoms or who have had close contract with someone with COVID-19 or have a temperature of 100.4 F. Furthermore, this service is vital and is needed immediately to help protect this federal facility and its employees and visitors.
2. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Maxim Healthcare Services, Inc. is the only Contractor that has the resources on hand to satisfy the Government’s needs immediately. Therefore, no other company was identified to be able to perform these services or provide a fair or reasonable price by the emergent and immediate need date. Additionally, this is a unique and compelling circumstance under the COVID-19 global pandemic, the program office sent this emergency acquisition request to contracting on 05-12-20 with a need date of 05- 14-20 Maxim Healthcare Services was the only contractor that was identified during this very short amount of time that could immediately respond and provide the services to meet the government’s needs, therefore The time it would take to solicit and procure this type of service would cause unacceptable delays for this facility which could put VA employees at risk and ultimately affect veterans’ healthcare services. Lastly, this requirement falls under Emergency Assistance Activities in support of Global Pandemic for Coronavirus Disease 2019 (COVID-19).
3. Description of market research conducted and results or statement why it was not conducted: This acquisition will not be synopsized IAW 5.202(a)(2) due to the required need date. The proposed contract action is made under the conditions described in 6.302-2 and time periods specified in 5.203. This acquisition was received by Contracting on 05-12-2020 with a need date of 05-14-2020. On 05- 13-2020

VHAPM Part 813.106 Original Date: 08/30/17 Revision 01 Eff Date: 04/23/2018 and pursuant to the Service Area Office (SAO) West Emergency Procurement Procedures, the Contracting Officer provided the Contractor with a Notice to Proceed (NTP) to start work under contract 36C25920C0135. This contract is a base year only to Maxim Healthcare Services Inc for $37,440.00 for the Base (05/14/2020 to 05/13/2021), for a total contract value of $37,440.00. Market research was conducted IAW FAR Part 10 on VIP, GSA e-Buy, SBA, and FBO where it did not find 2 or more SDVOSB /VOSB’s that were able to meet the urgency and complexity of this immediate emergency requirement.
Therefore, Maxim Healthcare Services is the only Contractor that has the resources on hand to satisfy the Government’s needs. Therefore, no other company can perform these services or provide a fair or reasonable price by the need date. The time it would take to procure this type of service would cause unacceptable delays for this facility which could put VA employees at risk and ultimately affect veterans’ healthcare services. Therefore, the Rule of two cannot be meet.
4. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. The Government is utilizing FAR Part 18 Emergency Acquisition Flexibilities – Emergency Assistance Activities in support of Global Pandemic for Coronavirus Disease 2019 (COVID-19).
