Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Brand Name Justification

1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration, Regional

Procurement Office West, Network Contracting Office 21 on behalf of San Francisco VA Health Care System.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The San Francisco VA Health Care System is requesting to purchase the Plethysmography system with spirometry, Thoracic Gas volumes, airways resistance, respiratory mechanics, nitrogen washout & real time diffusion capacity. Includes BreezeSuite software, Windows 10 Pro All-in-One computer, 3L syringe, startup kit, regulators for O2, DLCO & calibration gas and E Cylinder for calibration gas.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The system must have software that meet the new 2017 ATS and VA standards for patient care and results. The system must have a proven HL7 interface with a 510K approval that it is compatible with CPRS/Vista and Cerner. The interface must be able to send results back to our EMR in Discrete Data, Text, PDF (link and embedded).

FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(1)(i).

4. Description of market research conducted and results or statement why it was not conducted:

A sources sought notice was posted to opportunities under 36C26120Q0962 on 08/12/2020 closing on 08/18/2020, yielding two (2) responses from vendors indicating they could provide the Platinum Elite DX Body Plethysmograph with RTD P/N: 830008-902.

This action is being limited to the brand name product from MGC Diagnostics Corporation. Based on the requirements in the salient characteristics, the Platinum Elite DX Body Plethysmograph with RTD meet all the VA HIPAA/HITech security requirements.
