DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C261‐22‐AP‐0434

1. Contracting Activity: Department of Veterans Affairs, VISN 21, NCO 21 on behalf of the VA

Southern Nevada Healthcare System. PR# 593‐22‐1‐736‐0005

2. Nature and/or Description of the Action Being Processed:

This procurement is for the procurement and installation of Brand Name Axis external surveillance camers at the VA Southern Nevada Healthcare System in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303‐2.

The action being contemplated will result in the award of a new firm‐fixed price Purchase Order.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The VA Southern Nevada Healthcare System requires new external surveillance cameras to meet the requirements outlined in Section 889 of the National Defense Authorization Act. The proposed action requires the vendor to provide and install the following equipment along the exterior of the VA Southern Nevada Healthcare System located at 6900 N. Pecos Rd., North Las Vegas, NV 89086 at a total estimated cost of $274,959.97:

1) Axis Q6010‐E Multi Sensor Cameras ‐ 20 EA

2) Axis Q6075‐E PTZ Cameras ‐ 55 EA

3) Axis AC 24V Midspan 60W POE Injectors ‐ 47 EA

4) Milestone licenses ‐ 47 EA

5) Misc mount materials ‐ 53 EA

6) Remove and replace banned exterior cameras using a lift equipment and Labor services ‐ 1 EA

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106‐1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

External cameras at the VA Southern Nevada Healthcare System were mandated to be shut down effective 1/1/2022. This has the potential to significanty impact the safety and well being of both the facility staff and patient populations. On multiple occasions, significant emergencies as a results of falls or other health related issues have been responded to in the various parking areas expeditiously specifically due to being noticed on the external monitoring system. Without this system, it may be some time before the VA Police and medical staff are alerted to instances in the outside/parking areas that require medical assistance. Such a risk to the facilities many patients and staff well‐being is unacceptable, and therefore, the need demands urgent attention and is deemed urgent and compelling in nature.

DK&R is a local Service Disabled Veteren Owned General Contractor that has performed numerous projects at the VA Southern Nevada Healthcare System. They have performed satisfactorily in the past, and have indicated via initial customer market research and market research conducted by the undersigned CO that they are ready and available to urgently install the needed surveillance system at the VA Las Vegas. Therefore, it was determined to sole‐source this urgent requirement to DK&R Corp utilizing the authorities of FAR 13.106‐1(b)(2) and 6.302‐2.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

As this is a urgent need, the undersigned CO only performed that is specifically outlined in Question #8 below. Given the urgent and compelling nature of the VASNHCS’s need, it was determined that a more targeted market research approach be undertaken to identify an immediate local rescource that could meet the Government’s need. Subsequant to the results of the initial VIP search outlined below, it is understood that seeking additional sources via a sources sought would have likely resulted in some type of small‐business set‐aside; however, do to urgency it was not believed that the identification of further sources would have aided in meeting the Government’s urgent need.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The undersigned CO anticipates that costs quoted by DK&R Corp will be fair and reasonable. Pricing for the supply items will be compared against available online pricing for like items. Initial Market Research pricing obtained by the customer indicates that DK&R’s pricing for the surveillance system will be fair and reasonable. Additionally, the labor for the installation portion of the contract will directly compared to the prevailing labor rates outlined in the Davis‐Bacon Act.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

A search of the VA VIP database utilizing NAICS 334290 (Other Communications Equipment Manufacturing) resulted in the identification of 5 SDVOSB vendors that could potentially meet the Government’s need. As the initial contemplation is to utilize the sole source authority at FAR 6.302‐

2 (Unusual and Compelling Urgency), the undersigned CO made no further attempts via RFI/Sources Sought to further determine if the sources identified via VA VIP were viable. Lastly, as the facilities recommended vendor to complete the urgent work (DK&R) is a known local Las Vegas SDVOSB, a VIP Verification was conducted to ensure their status remains active, which it does.

A search of GSA Advantage revealed that the required cameras and mounting equipment appeared to be available via multiple GSA vendors; however, some vendors did not appear to provide installation, and others FSSs stated installation timeframes far greater that what is currently required by the facility to gain NDAA compliance and ensure the safety of the VA staff and patient population.

A search of SAM for DK&R Corp (DUNS 078589366) demonstrates that the vendor has an active SAM registration, without any active exclusions, and they are available for all awards.

This requirement has been determined urgent by both facility staff, the VISN and contracting due the potential impact that a facility without operational exterior cameras can potentially have on patient and staff well‐being and safety. Market research has determined the best method to meet the VASNHCS’s urgent need is to sole source this requirement IAW FAR 6.302‐2 (Unusual and Compelling Urgency) to local Las Vegas verified SDVOSB General Contractor DK&R Corp (DUNS 078589366) who have indicated both interest and capability in meeting the requirements of this need.

Facility will track useful life of the equipent and plan replacement procurement to allow for maximum competition.
