Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1 . Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO 21), on behalf of VISN 21, VA Southern Nevada Healthcare System (VASNHS), 6900 North Pecos Road, North Las Vegas, Nevada 89086.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The requirement is for a subscription of Zoll CaseReview software and support, and it must be compatible with the current, existing AED system and be available for immediate use with no start-up or implementation period. The CaseReview software permits the Cardiopulmonary Resuscitation (CPR) Committee to monitor patients’ CPR data, and this is a requirement of the Quality, Safety, and Value (QSV) program at the Department of Veterans Affairs (VA). Information from a Zoll defibrillator is automatically sent to a server after patients’ code blue events, and provides electrocardiogram (EKG/ECG) waveform data, CPR metrics, padz on time data, time to first compressions data, pre- and post-shock times, SpO2 data, and chest compression fractions information. The information is available immediately after a patient’s cardiac event, it is used for code blue event debriefs following a patient’s cardiac event, it provides data for trending CPR quality over time, and it is analyzed to determine opportunities for improvement.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Pursuant to 41 U.S.C. 3304(a)(5), as authorized by 38 U.S.C. 8127(b), and as implemented by FAR 6.302-5 Authorized or Required by Statute; a contracting officer may award a contract under the authority in this paragraph (b) to a VetCert certified SDVOSB for an amount less than the simplified acquisition threshold using procedures that are other than full and open competition. (38 U.S.C.
8127).
After Action Medical and Dental Supply, LLC is the only authorized reseller of the Zoll Medical Corporation’s software and/or to provide support services. No other manufacturer was identified as being an equal.
4. Description of market research conducted and results or statement why it was not conducted:
The Government’s technical experts conducted market research. This market research is an ongoing process since product inception and is continuously being conducted, as recently as June 2024.
There is no other available software in the marketplace per VA’s subject matter experts that can meet the VA Agency’s requirement of interoperability and compatibility requirements with current, existing systems. Last Updated: 02/01/22 Page 2 of 3 determined that only a Zoll CaseReview Software Subscription can meet the VA Agency's needs. The Acquisition Utilization Specialist (AUS) researched into the matter to determine if competition or limited competition did in fact exist. A search of VetCert, Adds Up, the mandatory sources, NASA SEWP, GSA, the internet, and the acquisition package was conducted, and it was discovered that there were only two vendors that could reasonably be expected to provide the items of the acquisition. One is Zoll Medical Corporation, which is the manufacturer and an “other than small business.” The other one is After Action Medical and Dental Supply, LLC, which is an SDVOSB. In addition, and based upon market research, it was determined that only the brand name “Zoll CaseReview Software Subscription” has the capability to satisfy this requirement. The system requires a software subscription that is compatible with the current, existing system. To procure and use the Zoll CaseReview Software Subscription is the only way to ensure proper integration, and it is advantageous to the Government because the cost is less than it would be if the equipment and the software subscription were both procured. The Zoll equipment and CaseReview Software are both proprietary to the manufacturer and available in the commercial marketplace.
SAM.Gov was reviewed, all of the notices found within the last year were for Zoll equipment and not the needed software. A justification was found for Defibrillators under ID as a sole source award to After Action Medical and Dental Supply LLC in the amount of .
FPDS was reviewed, where was found. This action was awarded on 09/12/2023 to
(SDVOSB) in the amount of for a subscription of Zoll CaseReview Software. This award was not competed. Additionally, was found, a sole source to After Action Medical and Dental Supply LLC in the amount of on 05/24/2023.
NASA SEWP was reviewed, with no relevant results. The SCMC was reviewed, with no relevant results.
GSA Advantage and GSA eLibrary was reviewed. A search was done for , which appears to no longer be active. However, was found, awarded to After Action Medical and Dental Supply on 65 II A. Though there is Zoll equipment on schedule, the needed software does not appear to be available.

Market research from was reviewed, which indicated that a sole source to After Action Medical and Dental Supply LLC was the only viable strategy.
The Station had submitted a distributor list from the OEM (Zoll) stating After Action Medical was the only distributor available.
