Justification for Brand Name Award IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C246-23-AP-6151
1. Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office NCO 6 located at 100 Emancipation Drive Hampton VA 23667, in support of VISN 06 Richmond VA Medical Center at 1201 Broad Rock Blvd Richmond VA 23249 purchase request 652-23-4-165-0226.
2. Brief Description of Supplies/ Services required and the intended use/Estimated
Amount: This is a stabilizer mount that partners with the CIVCO system attached to the exam table that enables the physician to acquire ultrasound images while performing complex ultrasound-guided fusion prostate biopsies. The stabilizer enables the physician to make precise movements with the ultrasound probe to gain the best image of the target lesion.
Estimated Value: $33,732.00
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This is limited to one source because this is part specific to our current hospital-owned CIVCO mounting system and EX3 stepper that holds the ultrasound probe during the procedure. This stabilizer mount is specific to the current CIVCO Dual-Sided Table Mount system that is in use. The use of another ultrasound stabilizer mount would result in the need to procure a new ultrasound stabilizer system, therefore, incurring additional costs that the government doesn’t expect to recover through competition.
4. Description of market research conducted and results or statement why it was not conducted: Market research was conducted and consisted of contacting the suggested vendor to verify CIVCO status and to inquire about authorized distributors CIVCO is the manufacturer and seller of their products and have three large company distributors that sell their products. The distributors are Medline, McKesson and Cardinal. CIVCO has provided a soles source letter. However, Richmond VAMC currently has in placed the CIVCO Mounting System and EX3 Stepper. An email from CIVCO on 8/28/2023 to the CS states that using other equipment from another manufacture for the Stepper to use along with the stabilizer would be considered improper use. Due to the product, the specifications, procedure types, micro adjustments needed, and potential risk of damage by an unknown mount, the stepper is only compatible with CIVCO stabilizer and mounts. The CO intends to pursue this requirement as an Unrestricted, Full and Open as the VA Rule of Two cannot be met. Brand Name Only.
