2. Nature and/or Description of the Action Being Processed: This is a Sole Source exception to fair opportunity request to award a contract for Fire Protection Services for the Boise VA Medial Center.

3. Description of Supplies Services Required to Meet the Agency’s Needs: The Boise VA Medical

Center will require fire protection service which can only be provided by the City of Boise Fire

Department and is regulated by and is a sub department of the City of Boise. The estimated cost for this critical service, Base Year: $191,817.00 and Total Contract: $631,355.00. The base year Period of Performance will be 10/11/2024 through 10/10/2025 and the two additional Option Years will end the contract on 10/10/2027.

4. Statutory Authority Permitting Restricted Competition: FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106‐1(b)(2) for restricting competition on this procurement. 5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The Boise Fire Department is the only agency that provides fire suppression services for the city of Boise, ID. Furthermore, it is the only fire department in Boise staffed by fully trained personnel capable of providing around the clock HAZMAT containment, divers rescue, and technical rescue service. The close distance between the Boise Fire Department and the Boise VAMC (7.4 miles) makes it the only Fire Department that can provide around the clock 24/7 emergency life saving fire or rescue response which is critical to the welfare of Boise VAMC staff and the Veteran’s in their care. The Fire Department will be responsible for providing all fire suppression, hazardous spill response, confined space rescue and other related emergency response services to the Boise VAMC.

This includes all VA owned buildings at 911 Mountain Road, Boise, and VA regional offices at 44 West Fort St, Boise, ID. Without this critical service the VA staff and the Veterans they serve could be subject to unnecessary risk of injury or death in the event of an emergency The proximity of the City of Boise Fire Department to the Boise VAMC is critical to contractors ability to be on‐site within 15 minutes in order to safe‐guard human life and property, control and suppress fires and provide other emergency service within the scope of their abilities.

The Boise VA Medical Complex comprises more than 40 occupied buildings, the largest being four stories tall. Fire protection in a facility this large can only be provided by a large well trained dedicated Fire Department which employs emergency ladders, safety rigging, state of the art emergency equipment, and life‐saving medical personnel and equipment.

Due to the critical nature of this requirement the Fire Department must not only have experience successfully supporting multiple locations but is also within the 15 minute response time of the facility where stringent firefighting protocols and direct onsite management is a premium. A review of current and previous contract for the same service revealed that there is only one Fire

Department in the proximity that can provide the rapid and highly skilled response that could possibly mean the difference between life and death of VA staff and Veterans should an emergency arise. According to the U.S. Fire Administration there has been six (6) home fire fatalities in ID since the beginning of 2004 and the Fire death rate has gradually increased over the last 10 years.

In addition to fire protection and technical rescue service they will be responsible for hazardous material spill response, clean‐up, and mitigation operations. The fire department is also responsible for facility inspections, building plan reviews, education of VA personnel and local code enforcement.

These capabilities are only available to highly specialized trained personnel who are required to fullfil proficiency and certification benchmarks on a routine basis.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A Sources Sought Notice, 36C26024Q0833 was posted to SAM which served as a notice to potential contractors of the Governments intent to Sole Source this acquisition if no qualified contrators were identified. There were zero responses. Fire Fighting is a unique service which is normally performed by

County or City Fire Departments and is not normally performed by private companies.

This is a follow on contract to VA contract 36C26024P0033 which was also a sole source acquisition and expires on 10/10/2024.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: There are no other identifiable vendors authorized by the City of Boise to conduct this fire protection services.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A review of the DSBS website using NAICS 922160 and location Idaho yielded zero (0) responsible small business certified to provide this service. A VetCert query was also conducted using NAICS 922160 which resulted in twenty seven (27) verified Veteran Owned contractors, none were located in Idaho. Additionally, a sources sought notice 36C26024Q0833 was posted to SAM which served as a notice to potential contractors of the Governments intent to Sole Source this acquisition if no qualified contrators were identified

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

There were no other companies expressing interest in the requirement. Fire Fighting is a unique service which is normally performed by County or City Fire Departments and is not normally performed by private companies.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
