Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 6.

Nature and/or Description of the Action Being Approved: Network Contracting Office 6 intends to award a new firm-fixed-price contract to Metrics LLC (SDVOSB) for Professional Acquisition Support Services.

Description of Supplies/Services Required to Meet the Agency’s Needs: The Veterans Health Administration (VHA) Regional Procurement Office (RPO) East, Network Contracting Office (NCO) 6, urgently requires professional acquisition support services. At present, NCO 6 lacks sufficient procurement resources to address the substantial backlog of contract closeouts, de-obligations, and modifications. The estimated value of this procurement is $ with a period of performance of a twelve (12) month base period and month options from September 26, 2025 through September 25, 2027.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:

( x ) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Metrics LLC is a certified Service-Disabled Veteran-Owned Small Business (SDVOSB) listed in the SBA SBS certification database. They have been evaluated and recognized as a responsible contractor for this requirement, demonstrating the necessary capability, integrity, and reliability to successfully fulfill the contract. Metrics LLC presently providing similar services to the VA and various other agencies. They have an immediate pool of qualified candidates with previous VA experience and proficiency in all VA-specific systems.

They have the necessary technical expertise, financial resources, and operational capacity to meet the performance requirement.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies:

Market research was limited to an examination of the acquisition history and experience withing the marketplace under previous acquisitions for the same or similar items. Metrics LLC already has trained personnel and is currently providing acquisition support services with the required level of contracting expertise. The time and effort in resoliciting, training, and obtaining the same level of expertise would not be cost effective and would result in a loss of productivity that would increase the backlog of contract closeouts, de-obligations, and modifications. A synopsis wasn’t posted in accordance with the exception in 5.202(a)(4) authorized by statute.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Prior to award of the proposed contract, price analysis will be performed and documented. The Contracting Officer will determine the proposed price to be fair and reasonable based on comparison on the proposed prices to prices found reasonable on previous purchases of similar services.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Limited market research confirmed that Metrics LLC meets the eligibility criteria outlined in VAAR 819.7003. As a verified SDVOSB in the SBA SBS database, they have the capability to provide immediate, qualified, professional acquisition support personnel familiar with the VA’s contracting systems and procedures.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.

Under 38 U.S.C. § 8127(c), a contracting officer may award a contract to a certified service-disabled veteran-owned small business (SDVOSB) listed in the SBA certification database using other than competitive procedures provided the anticipated award price of the contract (including options) will not exceed $5 million. Metrics LLC is a responsible contractor with respect to performance; and in the estimation of the contracting officer contract award can be made at a fair and reasonable price that offers best value to the Government.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No actions are planned to solicit competition for this requirement. The intent is to award a contract for these services for more than one year, as it is unlikely that a new contractor would possess the capability to provide employees that are already proficient in the VA’s procedures and systems. Furthermore, the necessary training on various contract systems and regulations would require substantial resources and result in a significant loss of productivity for the Network Contracting Office.

12. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:

a. Contracting Officer or Designee’s Certification (required): I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.

b. One Level Above the Contracting Officer (Required over the SAT but not exceeding $750K): I certify the justification meets requirements for other than full and open competition.
