Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity: Department of Veterans Affairs, VISN 17, Center of Excellence for Research on
Returning War Veterans, Central Texas Veterans Health Care System, 4800 Memorial Drive, Waco, TX 76711 and Network Contracting Office 17 VHA Regional Procurement Office-West (RPOW) 124 E HWY 67 Suite 100 Duncanville, TX 75137

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The
Central Texas Healthcare System is limiting competition to Brand Name for the acquisition of the laboratory instrumentation - Flow Cytometer, for The Biomarkers Core of the Center of Excellence upgrade under provision FAR 13. The intent of this procurement is to provide research on Returning War Veterans.
Estimated Amount: $178,750.00 (with $40,000.00 trade-in credit).
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The Flow Cytometer is unique in that this equipment upgrade is proprietary and is only compatible with the current existing equipment. The procurement of any other equipment would not be compatible. Procuring a different system from another manufacturer would require replacement of the existing Thermo Fisher Scientific equipment. Also, the acquisition of different equipment will required additional training resulting in unacceptable delays to patient care and will duplicate costs not expected to be recovered though a brand name or equal solicitation. .
The manufacturer offers the government a $40,000.00 trade-in credit not available from any equal products. It is only extended through the manufacturer and authorized distributor. Market research has determined its in the government best interest to procure this requirement as Brand Name Only.
4. Description of market research conducted and results or statement why it was not conducted: An initial
VIP query utilizing NAICS Code 334516 returned 3 possible SDVOSB/VOSBs eligible for a set-aside.
No aditional market research conducted, as Thermo Fisher Scientific provided a written letter indicating proprietary technology and they only partner with one small business. All mandatory sites were checked to include GSA, CCST, ECAT, VA SUPPLY CATALOG and NX Equipment. However, no further market research was conducted due to the required compatibility with the existing equipment.
