VHAPM Part 813.5 Simplified Acquisition Procedures for Certain Commercial Items Attachment 1: Request for Sole Source Justification Template >SAT-$7.5M under FAR13.5
DEPARTMENT OF VETERANS AFFAIRS
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5
Acquisition Plan Action ID: 36C260-21-AP-1573
1. Contracting Activity: Department of Veterans Affairs, VISN 20, VA Puget Sound Health Care System (VAPSHCS), Seattle VA Medical Center (SVAMC), General Medicine, 663-21-2-3323-0016.
2. Nature and/or Description of the Action Being Processed: The SVAMC has a new requirement for the development, upgrade and maintenance of a system to manage data acquisition, data storage, data access and security for the VA Office of Primary Care Analytic Team (PCAT).
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The proposed contract is a firm fixed price, five-year service contract (base plus four option years). Work will be performed within VAPSHCS located at the SVAMC. The purpose of this contract is to enhance the PCAT’s achievement of VHA and PACT priority goals focusing on care for complex or high-risk Veterans, implementation of the PACT model and its components, and telecare modalities. Evaluation of these priority areas necessitates the acquisition and management of data from over 50 sources, both within and outside the VA. The vendor will develop, upgrade and maintain an integrated data system that will greatly enhance the PCAT’s ability to manage all their data in a safe, secure, and easily accessible environment. The proposed price for the base year is $91,025.00 with an estimated life cost of $483,260.00.
4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:
(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements ( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The small business vendor, John Messina has 16 years’ experience working within the VA’s data environment, including over 8 years working as a Data Steward for the VA’s Office of Analytics and Business Intelligence, and over 6 years direct experience working with and building data systems specifically for the Patient-Aligned Care Team-Demo Lab Initiative. In addition to extensive knowledge of the Office of Primary Care’s data and access procedures, Mr. Messina has experience building and managing multi-terabyte data systems for investigators as well as managing data security and monitoring access. His extensive experience and direct knowledge of the data systems specific to Primary Care and the PACT teams makes him uniquely qualified to quickly assume the lead in redesigning and building the PCAT’s databases and data access systems without spending precious time coming up to speed on the complex data and the access procedures in place
Mr. Messina is specifically written into the Primary Care approved PCAT budget. No other source could provide these expert services at the quoted price point without extensive (2-3 years) and expensive ($50-75K) training. No feasible individual or organization could conduct this contract without a negative impact on the PCAT
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No other sources were contacted as John Messina has unique qualifications that are unavailable from any other source.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: When compared to the previously awarded contract 36C26019P0642 the proposed prices represents a three percent increase from the prior year $88,374.00. IAW FAR 13.106-3(a)(2)(ii) the proposed contract is fair and reasonable.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A search of VIP was conducted. However, since John Messina has the expert services and direct experience with VHA Primary Care and the Primary Care Analytics Team, market research was not conducted. No market research was conducted because no one else has the necessary direct experience and depth of knowledge of the Primary Care Analytics data and systems as Mr. Messina. Hiring or contracting and training someone unfamiliar with the specific PACT/PCAT data and data access systems would unnecessarily delay our ability to meet our 2021 - 2026 strategic plans and mandated milestones.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: N/A
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
