Acquisition Plan Action ID: 36C246-20-AP-3182
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 6, W.G. Bill Hefner Veterans Affairs Medical Center, 1601 Brenner Avenue Salisbury, North Carolina 28144; Requisition Number 659-20-3-6049-0385.
2. Nature and/or Description of the Action Being Processed:
A new Firm-Fixed-Price contract is being awarded to Siemens Industry, Inc. with a period of performance 06/15/2020-12/15/2020, for a total estimated value of $293,884.60. This is for an emergent requirement to support COVID-19 Pandemic efforts.
FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is an emergent acquisition in support of the COVID-19 Pandemic for negative pressure monitors for the isolation rooms at Salisbury VAMC with a central monitoring location in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The Contractor shall provide and install all necessary equipment to update the negative pressure monitors with Siemens pressure monitors to be fully integrated with the Siemens Desigo CC Building Automation System. The Contractor shall provide Siemens Industries BACnet network switches, CAT-6 wiring, wifi bridge, mechanical system & floor plan graphics, trending and alarm setup, and initial scheduling for network integration. The Contractor shall furnish and install Siemens DDC controls for each Isolation Room including: controls supply and exhaust unit, one (1) room pressure monitor with full color display, one (1) annunciator module, one (1) discharge air temperature sensor, one (1) full display zone sensors, and one (1) door alarm. The Contractor shall provide all equipment necessary for central location monitoring controls including: alarm screen, one (1) desktop computer, one (1) flatscreen, one (1) alarm screen graphic, and one (1) laptop computer and all associated software. The estimated value of this service is $293,884.60, and should require a 6 month period of performance to complete fully integrated installation.

FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
This is an emergent need to support the National Emergency Concerning the Novel Coronavirus Disease (COVID-19) Outbreak declared on March 13, 2020 by President Donald Trump. The current COVID-19 patient isolation rooms at W.G. Bill Hefner Veterans Affairs Medical Center (VAMC) require staff to physically visit each room and view each pressure monitor often throughout the day and night to ensure that the air pressure stays negative preventing contaminated air from seeping into adjoining rooms placing patients and staff at risk. Not only is this dangerous to patients and staff, but this is an inefficient use of staff time during a period where staff members are especially essential. W.G. Bill Hefner VAMC is in need of a pressure monitoring system that can be viewed remotely in a central location to provide the necessary protections to patients and staff. By installing the new Siemens pressure monitors, Engineering will be able to view the room pressures remotely and document at the frequency VA leadership and national guidelines require. The new monitors will be visible on the building control system (BCS) that was installed by Siemens. This is an emergent staff and patient safety issue which needs to be installed without delay.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
The Vendor Information Pages (VIP) database was searched, via the following link https://www.vip.vetbiz.gov. Forty One SDVOSB/VOSB vendors were identified, and no other publications or notices were utilized. Market research is detailed in in the market research section of this document.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The Contracting Officer researched the average hourly rates for Project Managers, Engineers, and Electricians from previously awarded GSA contracts via https://calc.gsa.gov/ to determine fair and reasonable prices for the labor for this service. All necessary equipment is listed on GSA contract GS- 07F-217CA, which was viewed to determine equipment price reasonableness. Quotation prices will be broken down accordingly to determine price reasonableness for the labor and equipment. Fair and reasonableness determination will be documented.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market Research was conducted for this procurement. The Vendor Information Pages (VIP) database was searched, via the following link https://www.vip.vetbiz.gov. The search was limited to NAICS Code 541990; keywords: negative pressure monitor. Forty One vendors were produced.
Due to the emergent nature of this acquisition, no vendors were contacted for capabilities from this search. Siemens Industry, Inc. was contacted for capabilities and quotation since they are the direct vendor with the known proprietary equipment to integrate the monitors into the current Siemens https://www.vip.vetbiz.gov/ https://calc.gsa.gov/ https://www.vip.vetbiz.gov/

Desigo CC building automation system at W.G. Bill Hefner VAMC. Utilizing the current system is the most cost and time efficient providing the best value to the Government for purchasing the monitors. The Contracting Officer reviewed contract 36C24620P0376 for the system support and maintenance of the Siemens Desigo CC Building Automation System, which resulted from an Open Market Sole Source acquisition with Siemens Industry, Inc. The Market Research for this acquisition included a posting of an Intent to Sole Source to beta.sam.gov yielding no responses, and included a Proprietary Letter provided by Siemens Industry, Inc. According to the letter, service and installation of Siemens equipment is proprietary to Siemens Industry, Inc. The Contracting Officer did not attempt to find a Small Business that may have been an authorized distributor or post an intent to sole source for this acquisition of the negative pressure monitors due to the urgent and compelling nature. The Contracting Officer determined that it was in the Governments best interest to seek a sole source procurement with Siemens Industry, Inc.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
This procurement is in support of the National Emergency Concerning the Novel Coronavirus Disease (COVID-19) Outbreak declared on March 13, 2020 by President Donald Trump.
