1. Contracting Activity: Department of Veterans Affairs, VISN 21, VA Palo Alto Healthcare System

2. Nature and/or Description of the Action Being Processed:

The Education Center AV was installed nearly a decade ago and the Simulation Center equipment was purchased by the government and then subsequently the equipment became dated before the installation took place in 2018 as government furnished equipment. Since then, the systems have had many operational issues develop with faulty equipment, signal speed, and ease of use. Many of the system components are outdated and beyond lifecycle. These issues have hindered the learning center staff from presenting various streaming content during New Employee Orientation (NEO) training in bldg. 105, and has hindered simulation activities for the medical staff.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The contractor will be required to purchase and install audio/visual equipment which is in need or replacement and will be fully integrated into the current system. The contract total will not exceed $450,000.00, and the period of performance will run approximately 180 days.

4. Statutory Authority Permitting Other than Full and Open Competition: .

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Strategic Industry is a certified Service Disabled Veteran Owned Small Business (SDVOSB) who performed the original equipment installation for building 105, and is considered a small business for NAICS code 238210.

The as built for the original installation were a product of contract 36C26118C0148 which was competitively awarded to Strategic Industry. The equipment was government furnished equipment acquired from a previous construction project. This approach is also allowable under FAR 6.302-1 (A) (ii) logical follow on whereby the contractor who performed the contract for the previous phase has knowledge and experience with the project or program that no other company possesses and which accrues to the benefit of the government.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Initially it was thought that efforts made to ensure that offers were to be solicited under the NCO 21 MACC Group II. However, it was noted that the work to install the government furnished equipment and the current layout was handled by another SDVOSB firm in 2018, therefore it was deemed to be in the best interest of the Government to award this project as a Sole Source award, within the Statutory Authority of 819.7007.

A determination that only one (1) SDVOSB concern is available to meet the requirement is not required. The anticipated contract award price will exceed the Simplified Acquisition Threshold (SAT) but will not exceed $450,000.00.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Prices will be determined fair and reasonable based on the catalog prices for the replacement equipment, published Davis Bason Wages, the Independent Government Cost Estimate and the cost of the original installment contract 36C26118C0148.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market research was not conducted, as we have several known small SDVOSB contractors under the NAICS code 238210.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

Strategic industry has the knowledge of the current system in place and is aware of some of items that may be affected by date, or equipment whose manufacturer no longer exist, as was evidenced at time of inventory of the government furnished equipment.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required:

Once the system becomes fully outdated, it will be solicited full and open to all SDVOSB firms, under the NAICS code 238210.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
