Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Brand Name Only
Acquisition Plan Action ID: 36C246-22-AP-4065
1. Contracting Activity: Department of Veterans Affairs, NCO 6 Charles George, Asheville VA Medical Center located at 1100 Tunnel Rd, Asheville, NC 28805. Purchase Number: 637-22-3-97550-0036.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The Advantage Plus is a fully automated, computer-based asynchronous endoscope re-processor that monitors each endoscope channel separately for blockage and proper flow ensuring complete high-level disinfection. A computerized detection system eliminates human error in the selection and connection of hook-ups.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
This is a Brand Name requirement for the Charles George, Asheville VA Medical Center Nursing Services to procure four (4) replacement STERIS Corp, Advantage Plus Endoscope Reprocessing Systems in support of their Sterile Processing Department. The SPD Staff’s daily standard of operating procedures have been written based the use of the current Advantage Plus Endoscope Reprocessing systems they have been using since 2014 which have reached their end-of-life cycle.
Purchasing of the ADV-1008, Advantage Plus Endoscope Reprocessing systems would allow for a consistence in patient care and would save the facility funding for the on-hand stock of consumable items used with the current re-processors would be compatible with the new replacement units. The units would have addition cost savings also for the workspace required for the replacements would be exact the same space as the old ones and would not require any modifications to any plumbing, electrical, or structural fixtures. It would not be financially or economically feasible to change brands at this time.
4. Description of market research conducted and results or statement why it was not conducted:
Market Research for the Brand Name Only requirement for four (4) Advantage Plus Endoscope Recompressing Systems has been found to be available via Open Market from the OEM: STERIS Corp. (Large Business) which was discovered to have bought out the former OEM Medivators Inc. STERIS Corp. has started that all Advantage Plus products are proprietary to the STERIS Corp, however; they did provide a list of its authorized distributor list which included, The Janz Corporation (SDVOSB) who has provided a Letter of Authorization and Capability statement as part of their sources sought response. With the OEM’s list of authorized distributors having more than 2 SDVOSB ‘s along with identifying 3 SDVOSBs form the VIP search it has been determined that the Rule of Two can be met and that it would be most advantageous acquisition strategy for the government is to set this VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
Last Updated: 02/01/22 acquisition aside for FFP 100% SDVOSB set-aside IAW FAR 19.502-2 and FAR Part 13. Award will be firm fixed price to the lowest priced technically acceptable.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
