ITEMS IN ACCORDANCE WITH FAR 13.5

BRAND NAME JUSTIFICAITON

1. Contracting Activity: Department of Veterans Affairs, VISN 22, VA Greater Los Angeles Healthcare

System for Purchase Request# 691-24-2-4098-0057.

2. Nature and/or Description of the Action Being Processed:

This procurement is to establish a new Firm-Fixed price contract to procure six types of 9mm and .233 small arms ammunition for VA Greater Los Angeles Healthcare System in accordance with FAR

13.5 Simplified Acquisition Procedures for certain commercial items. Purchased ammunition will be used for police training and duty requirements. With the constant use of both training and duty ammunition, it is crucial to keep sufficient supply at all times.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

VA Greater Los Angeles (GLA) Healthcare System requires both duty and training ammunition for the police service. All duty ammunition shall be brand name only in accordance with VA Handbook 0720 OS&LE Model SOP Chapter IV F, section 5, b. dated 2010. The estimated cost of this requirement is

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

VA Greater Los Angeles Police Service is currently utilizing ammunition for police training and duty purposes. Ammunition is used regularly by police officials in order to matain proficiency and readiness. With the constant use of duty ammunition, it is important to maintain sufficient reserves of duty ammunition at all times in case of emergencies. Not only can supplies become depleted during major security incidents, ammunition also contains a limited shelf life. This ammunition purchase will ensure VA GLA Police Department is able to safely and effectively fulfill their mission of protecting veterans, staff, and visitors. Specific Duty Ammunitions such as Remington Arms Golden Saber, Federal Premium HST, Federal-Tactical Bonded Ammunition, and Speer Gold Dot Duty are the only brand names to be used as specified in OS&LE Model SOP Chapter IV F, section 5. The using service is in need of specified duty ammunition in order to keep inventory up-to-date. VA Greater Los Angeles cannot utilize a different type of duty ammunition aside from those mentioned, as this would go against the policy set in place.

Such brands as Remington Arms Golden Saber, Federal Premium HST, Federal-Tactical Bonded Ammunition, and Speer Gold Dot Duty are the only firms capable of providing the required duty ammunition described in Section #3 above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements. Hence, it is in the governments best interest to procure only the specified types of duty ammunition to avoid potential violations or infringing against policy. A copy of the VA Police Firearms policy is uploaded to eCMS as P03.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Small Business Administration (SBA)’s VetCert was utilized to survey SDVOSB and VOSB under the appropriate NAICS code. SAM.gov and FPDS portals were researched to study the similar past procureemnts and its procurement methods. GSA Advantage was also utilized to review if requested ammunition was available under contract holder lists. A sources sought notice was not published for this specific procurement, however I was able to review a previous procurements sources sought results from a similar requirements I posted done in December 2023.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

This is solely for a partial brand name only justification. Based on conducted market research, there are other interested vendors who are willing to provide quote/offer fair and reasonable pricing.

Hence contracting anticipates to compete this requirement, and determine fair and reasonable through an adequate competition in the open market.

There are no current plans to make changes to VA Police Firearm Policy.

Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
