Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C262-23-AP-6397
1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Offfice 22 (NCO
22) in Long Beach, CA seeks to procure supplies/services listed in Purchase Request # 664-23-2- 3377-0014 for VA San Diego Healthcare System.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: VA San
Diego Healthcare System Sterile Processing Service (SPS) has a requirement to purchase Belimed steam sterilizer and its accesesories to sterilize instrument sets for quick turn overs for back-to-back surgical procedures in operating rooms (OR). The current used equipment has reached its end-of-life-cycle and can no longer be repaired. The removal of old and installation of new equipment service are also requested. The total estimated cost is $ .
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: VA San Diego SPS is requesting the updated version of the same equipment that is currently being used in the SPS prep OR. In-service training has already been conducted, and using personnel are familiar and well versed in using the current brand’s equipment. Any equipment different from what is currently being used would require additional training. Also the using service has already established the maintenance and repair contracts with Belimed (under contract# 36C26223C0127 which was executed on 4/23/23 for base plus option 4 years). Multiple Belimed’s sterilizers are currently in use at the facility. VA SD SPS already has this brand in use and to prevent any delays, standardization, integration, training and patient safety, keeping continued standardization with this brand is the key to VA providing optimal care to Veterans. Procuring a different brand’s steam sterilizer equipment would result in additional cost and labor for training and setting up a separate maintenance and repair contract with a different vendor. Hence it is in the Governement’s best interest to procure the brand name Belimed’s sterilizer and its accessories.
4. Description of market research conducted and results or statement why it was not conducted:
SAM.gov and FPDS were utilized as a part of market research. However, there was no related results for Belimed brand’s equipment purchase, only maintenance and service contracts related. GSA Advantage was researched to review if Belied Sterilizers are under Federal Supply Schedule, but none was identified. Sources sought notices were posted on SAM.gov and GSA eBuy as a brand name requirement. Two verified SDVOSB vendors responded to the sources sought posted on SAM.gov and expressed interest in this requirement. Belimed, the original equipment manufacturer (OEM), is considered a large business under NAICS code 339113; verified via SAM.gov. Therefore, this acquisition is subject to Non-Manufacturer Rule. Hence it is recommended to set this acquisition aside to Small Businesses in the open market to promote competition in accordance with FAR
13.104 and FAR 19.502-2.
