Brand Name Justification IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C262-23-AP-5923

1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office 22 (NCO22) in Long Beach, CA seeks to procure supplies/services listed in Purchase Request # 678-23-3- 785-0022 for VA Tucson Healthcare System.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: VA Tucson Healthcare System Sterile Processing Service (SPS) needs Inspektor Borescope and Touch Mini Scope’s parts and accessories. Borescope and Mini Scope are used to inspect instruments with lumens in order to prevent debris and bioburdens from remaining unseen. SPS needs to replace only defective components of already existing borescope and mini scope to facilitate cleanliness and structure integrity, while inspecting and reprocessing in order to eliminate the possibility of damage to the equipment and harm to patients. The estimated value of the proposed action is $ .

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: VA Tucson SPS is currently using Inspektor Borescope Direct View System along with Inspektor Touch Mini Scope. The using service only needs to replace defective components and to augment the current system. VA Tucson SPS cannot utilize a different brand as the entire Borescope system would have to be replaced and this would not be cost-effective to the Government. Procuring the brand new equipment would result in additional cost and labor. VA Tucson already has this brand in use and to prevent any delays, standardization, integration, training, and patient safety, continued use is the key to VA providing optimal care to Veterans. Hence it is in the Government’s best interest to procure only the defective components for the current system.

4. Description of market research conducted and results or statement why it was not conducted: A sources sought was posted on SAM.gov as a brand name requirement, and the result revealed there is only one authorized SDVOSB distributor of Inspektor named Veterans Healthcare Supply Solutions, Inc (VHSS). A direct inquiry was made to Thomas Scientific, the original equipment manufacturer (OEM), to locate additional authorized SDVOSB distributors; however, there was none besides VHSS. Therefore, it is recommended to set this acquisition aside to a small business in the open market.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

(COs are required to make a determination of price reasonableness IAW FAR 13.106-3.)
