SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5
BRAND NAME JUSTIFICATION
Acquisition Plan Action ID: 36C262-24-AP-2521
1. Contracting Activity: Department of Veterans Affairs, VISN 22, VA Greater Los Angeles Healthcare
System under PR# 691-24-2-2349-0014.
2. Nature and/or Description of the Action Being Processed: This acquisition is to set up a firm fixed-price contract to procure the brand name Getinge cart washer for VA Greater Los Angeles (GLA) Sterile Processing Service (SPS). Getinge cart washer is to help with high-capacity reprocessing needs in an emergency-efficient design. The cart washer system delivers the reliable cleaning needed to prevent cross-contamination and keep patients safe. The cart washer is essential to safely clean and disinfect transport carts, containers, bowls, basins, and other bulky items. The de-installation of old Getinge cart washer and installation of new cart washer is also requested.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: VA GLA SPS has a request to replace the existing cart washer to the brand name only item: 9125E Getinge Washer Disinfector.
The current unit has reached its end of life, is beyond economical repair and need to be replaced.
The washer is to disinfect containers that store Reusable Medical Devices (RMDs) by placing them on a specialized rack designed for the cart washer. The SPS needs a cart washer in order to clean and disinfect RMDs for patient care. Without this equipment, patient care would be compromised. The SPS requires a Cart Washer that is able to clean up to 24 containers or 30 instruments trays in an 8-hour period. Additionally, the new cart washer is required to be plug and play system in order to fit into a custom cut area, approximately 37.8” W x 98.4” D x 78.7” H, within the SPS shop, and the new equipment must utilize existing connections for exhaust, water, and drainage. 4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
VA Greater Los Angeles Sterile Processing Service (SPS) currently utilizes Getinge brand Ultrasonic cleaner, Getinge sterilizer, Getinge small tabletop ultrasonics, Getinge Water Treatment System, and Getinge washer sterilizer. The SPS currently have supplies and inventory on hand and also have a Getinge service contract (contract# ), which was awarded on 6/5/23, for base plus option four years. Procuring the same brand of cart washer will aid in standardization, training initiatives, and eliminate the burden and cost of having different vendors on site for repairs and maintenance service. Moreover, VA GLA SPS already has established Standard Operating Procedure (SOP) and competency in use for Getinge cart washer as well.
VA GLA SPS requires a new cart washer to be a plug-in play system that fits into an existing custom cut, approximately 37.8” W x 98.4” D x 78.7” H, within the SPS shop area. The SPS vetted other brand names cart washer such as and . VA GLA Engineering reviewed all brands’ equipment electrical, plumbing, and HVAC requirements for new installation. Other brand names’ cart washers are built with HVAC and utility connections that are not compatible with existing facility hookups. To accommodate other brand names’ cart washer equipment, a whole new construction project would be required to re-route all electrical, plumbing and HVAC connections, which will ultimately cost more money and time consuming to the Government. Any delays caused by the new construction will ultimately disturb and affect direct patient care. Based on the using service’s need and existing conditions, any other brand name or similar items will not suffice.
Therefore, the Getinge brand name is the only firm capable of providing the compatible cart washer described in section #3 above without the Veteran’s Healthcare Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Small Business Administration (SBA)’s VetCert was utilized to survey potential SD/VOSB vendors under the appropriate NAICS code. SAM.gov and FPDS portals were utilized to study the similar past procurements and its procurement methods. As the requested equipment is considered medical equipment, VA National Acquisition Center MedSurg Catalog and GSA Advantage/eLibrary portals were utilized. Details of conducted market research are described under section #8.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
This is a brand name justification. Based on conducted market research, there are other interested vendors who are willing to provide a fair and reasonable pricing against the solicitation. Hence the contracting anticipates to compete this requirement as a brand name only and determine fair and reasonable through an adequate competition in the open market.
If an adequate competition is not received, the contracting will determine price reasonableness based on a comparison of the proposed quote to the Independent Government Cost Estimate and possibly based on comparison of proposed prices.
