Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C263-25-AP-0988

1. Contracting Activity:

Department of Veterans Affairs, Network/Program Contracting Office 23, in support of Saint Cloud

VA Health Care System.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Saint Cloud VA HCS requires the replacement of three Genexpert IV-2 Analyzers that will lose support on 31 December 2024. This is an emergency requirement and is being processed as such.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The service agreement for the cepheid system is set to expire on 31 December 2024 and will no longer be covered due to the availability of parts. This system is used to perform Influenza testing, Strep and COVID. Cepheid is the only source for this instrumentation and no other vendor provides the reagents needed for this analyzer. Reagents used are currently set up on a VISN wide IDIQ 36C26325D005. No other company manufactures reagent cartridges that are compatible with the Cepheid instrumentation. The Cepheid system allows the MRSA Directive to be carried out efficiently with a system that can also perform COVID 19 testing, C. difficile and Influenza testing simultaneously. The Cepheid system allows for immediate testing of samples without delay in the Saint Cloud VA HCS. This Cepheid system will not require any space modifications or additional training of staff, allowing a seamless transition, preventing any lag in patient specimen testing.

4. Description of market research conducted and results or statement why it was not conducted:

a. Conducted a query on SBA Veteran Small Business Certification (VetCert) using NAICS Code “334516”. The search listed a combined 234 Service Disabled Veteran (SDV) / Veteran (V) Owned Small Businesses.

b. Searched GSA eLibrary and used key words “334516”. Multiple companies with existing GSA contracts appeared, however, these contracts are unable to satisfy the requirement.

Searched GSA eLibrary and used key words “CEPHEID”. CEPHEID has an existing GSA contract, however, the requirement is for the replacement / trade-in of equipment that will be unusable on 31 December 2024.

c. Conducted a search on Federal Procurement Database Systems (FPDS) using keywords: “334516” DEPARTMENT_FULL_NAME:” VETERANS AFFAIRS,DEPARTMENT OF” and produced 84,513 results showing contracts awarded by the Department of Veterans Affairs with NAICS code 334516.

Conducted a search on Federal Procurement Database Systems (FPDS) using keywords:“ W6HQTMWB9Q28” DEPARTMENT_FULL_NAME:” VETERANS AFFAIRS,DEPARTMENT OF” and produced 8,657 results showing contracts awarded by the Department of Veterans Affairs to

CEPHEID.

d. Conducted a search on DSBS SBA using NAICS Code: “334516” in North Dakota. The search listed 264 SDVOSBs, 37 VOSBs, 92WOSBs, 38 EDWOSBs, 58 Hubzone certified and 63 Joint ventures.

e. Conducted a Search on SAM and used key words “W6HQTMWB9Q28”. This vendor is registered and expires 11/20/2025.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
