Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

• Description: Additional GE Lunar iDXA Reading Workstations with enCORE v18 Software Licenses for the Phoenix VA Healthcare System (PVAHCS).

Acquisition Plan Action ID: 36C262-23-AP-3622

1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office 22 (NCO 22) in Long Beach, CA, seeks to procure the supplies / services listed in purchase request 644-23-2-201-0067 at/for the PVAHCS, Phoenix, Arizona.

2. Brief Description of Supplies / Services required and the intended use / Estimated Amount:

Additional GE Lunar iDXA Reading Workstations with enCORE v18 Software Licenses. Estimated Cost: $18,368.00 USD.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Additional GE Lunar iDXA Reading Workstations with enCORE v18 Software Licenses for in-use equipment applications allows PVAHCS upgraded and increased functionality of imaging systems for diagnosis and treatment, and ensure seamless operability.

Software is proprietary developed by GE Healthcare for use on their imaging equipment. Generic or other compatible software does not exist that would permit increased licenses for/to the GE Lunar iDXA Reading Workstations with enCORE v18 operating system. Due to exclusive licensing agreements of proprietary software/technology, time constraints, and item being unique to one manufacturer, GE Healthcare, Inc. – original equipment manufacturer (OEM) and its authorized distributor(s) are the only sources who can provide needed software licenses and use of any other product(s) would be incompatible and render vital medical equipment useless and void of any warranties. Circumstances of contract action deem only one source reasonably available due to proprietary software, urgency, time constraints, and critical and unique nature of requirement per FAR 13.106-1(b) and VAAR 819.7008, and no other supplies or services will meet agency need.

Additionally, following established competitive procedures would result in unacceptable delays with increased risk to patient care.

4. Description of market research conducted and results or statement why it was not conducted:

Limited market research (MR) performed due to proprietary software, urgency, time constraints, and critical / unique nature of requirement. Results from SBA VetCert and VIP query by applicable North American Industry Classification System (NAICS) code 334510 identified 295 SDVOSB / VOSB vendors who could potentially perform the requirement. However, VA Rule of Two does not apply and there is NO reasonable expectation that 2 or more qualified SDVOSB / VOSB / SB vendors can, could or would submit offers to meet mission need. Conclusion – recommend single / sole source award to GE Healthcare, Inc. – large business / OEM authorized SDVOSB distributor TrillaMed, LLC, a SAM registered SDVOSB vendor IAW FAR Part 13 and VAAR 819.7008.

5. Contracting Officer's Certification: Purchase is approved in accordance with

FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
