2. Nature and/or Description of the Action Being Processed:
The Government requires a new firm fixed price construction contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The St. Cloud VAHCS has a requirement for three (3) separate modular structures and one (1) auxiliary connection point for its COVID care and screening program. The COVID care building/trailer is to provide COVID consulting, screening and testing, and specimen gathering. The location is on the southwest side of the southwest patient parking lot located south of Building 1. The proposed sites do not have existing utilities. All required utilities needed to support the functions of each building are the responsibility of this contract (design coordination, installation at source, installation from source to trailer and connection to trailer). The ancillary construction of utilities, foundations and associate infrastructure, and additional miscellaneous ancillary construction are to be installed under this contract with the mobile buildings/trailers. The ancillary construction and the construction of the trailers shall meet or exceed current Minnesota State codes and comply with manufacturer information (whichever is more stringent). In addition to the main COVID care building, two (2) separate check point buildings will be required at each of the entrances from Veterans Drive. The check point buildings will house the screeners and provide shelter from the elements. The Government requires the contractor to setup utilities, setup structures, maintain structures and provide for the lease of each of the structures.
Estimated Value: $860,544.89 Estimated Period of Performance: 70 calendar days from NTP for site prep & utilities, 10 month lease period.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Due to the COVID 19 pandemic, there is a need for site security and screening of all VA patients and personnel entering the St. Cloud VAHCS. This requirement will provide one (1) structure for clinical screening and two (2) structures for vehicle checkpoint initial screening. Currently, security members are operating out of vehicles. Weather conditions in Minnesota require utilities to be in place before the ground freezes. These structures are urgently needed to continue the screening process through impending harsh Minnesota winter, protecting both staff and veterans from the elements.
The contractor will be:
Integrated Modular Solutions, LLC (IMS) 210 E. 5th Street Bonham, TX 75418 DUNS# 006609211, VIP: verified SDVOSB; SAM: verified no active exclusions
IMS has successfully completed utility and structure setup at other VAs across the country. After discussing their capabilities, they have knowledge of developing structure configurations, specifically related to recent COVID 19 requirements. IMS has the capability to rapidly mobilize and place the structures meeting VA emergent schedule needs.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with FAR 5.202(a)(2), this action will not be synopsized and/or solicited because Veteran Patients and the Government would be seriously injured if Contracting complied with the solicitation time periods specified in FAR 5.203, i.e., a 15 day posting and a 30 day response time.
The Government does not have time to properly solicit this project when COVID 19 is continuing to spread locally, nationally and globaly.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The Contracting Officer shall determine the cost for this procurement will be fair and reasonable based on thorough review of historical procurements, the Independent Government Cost Estimate (IGCE), the contractor’s proposal, and the Contracting Officer Representative (COR) technical evaluation of the proposal.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market research was performed via VIP for those registered under NAICS code 531120, Lessors of Nonresidential Buildings. The results found 144 potential contractors, of which 126 were SDVOSB and 18 VOSB. A Fed Data Check was pulled for IMS and the results show IMS as a responsbible contractor. Additionally, temporary structure contracts for VISN 23 sites were also reviewed, OFOC SOP Revision 10 Page 3 of 4 Original Date: 03/22/11 Revision 10 Date: 09/10/2020 reference contracts: VA263 16 C 0098, GS 07F 0222X VA263 14 J 0967, GS 07F 0222X VA263 16 F 0458.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
IMS possesses the ability to quickly fabricate temporary structures out of shipping containers that will greatly reduce cost, schedule and setup times.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
There are no plans at this time for future acquisitions of this nature. It is the agency’s goal that future acquisitions for temporary structures are competed.

II. Procurement Information.
A. Procurement History.
Requirement was not previously known, nor previously procured as this need arose due to COVID global pandemic.
No previous procurement history.
B. Procurement Background.
The COVID Incident command identified required 24hr a day, 7 days a week screening positions on campus. Multiple locations are required to protect staff and patients at the campus. Two vehicle screening locations are required to secure/screen the outer perimeter. Clinical screening is required to further screen any higher risk individuals prior to entering the general population of the campus.
Currently the screenings are being conducted in shelters that are not protective of the Minnesota winters. It has been determined that COVID screening will last at least thru the winter of 2020. Therefore, there is an emergent need to provide staff and patients with screening structures that can shelter individuals from the below freezing and subzero temperatures that are consistent in Minnesota winters.
Program Office for this project is the Facility Management Office of St Cloud VA.
Point of contact is the COR. Key stake holders include the COVID planning committees, engineering, and the frontline staff exposed to subzero temperatures for 24hr a day.

III. Initial Requirements This is a turn key equipment with ancillary infrastructure installation contract (foundation, electrical, plumbing, mechanical, sewer, power, communication and site work). The St Cloud VA Medical Center (SCVAMC) has a requirement for three separate modular structures and 1 auxiliary connection point for its COVID care and screening program. The COVID Care Building/Trailer is to provide COVID consulting, screening and testing and specimen gathering. It has been determined that the structure shall be constructed on at the location illustrated on the attached coordination documents. The location is on the south west side of the south west patient parking lot located South of Building 1. The current sites do not have existing utilities. All required utilities needed to support the functions of each building are the responsibility of this contract (design coordination, installation at source, installation from source to trailer and connection to trailer). The ancillary construction of utilities, foundations and associate infrastructure and additional miscellaneous ancillary construction are to be installed under this contract with the mobile buildings/trailers. 38 U.S.C. 8127 (i) Priority for Contracting Preferences. Provides that preferences for awarding contracts to small business concerns shall be applied in the following order of priority: (1) SDVSOBs, followed by (2) VOSBs, including SDVOSBs, then (3) 8(a) and HUBZone firms and (4) any other small business. The order of priority was established in 2006 by Public Law 109-461, as per the policy in the Small Business Act at that time. Since then, as a result of legislative amendments to the Small Business Act, the FAR has been amended to create a woman-owned small business set-aside and to provide parity among the various small business socio-economic programs.
